NECU files petition against state government

Kohima, December 19 (MExN): The Nagaland Electricals Contractors’ Union (NECU) has filed a writ petition before the Gauhati High Court “asking for issuance of appropriate writ or order or direction” to the State Government “not to energize the Super Market Kohima.”


NECU in its plea maintained that “the electrical work carried out by the civil contractor” was in “total violations of the Indian Electricity Rules, 1956 and the Government standing orders.”


The Union president Kevichulie Chadi and general secretary HS Rotokha in a press release informed that the “contractors as a union being aggrieved by a work order dated 8th August 2012” which was awarded to “M/s Golden Traders was not registered as an Electrical Contractor under Electrical Inspectorate, Nagaland, Kohima.”


“The electrical works was done by a non-registered electrical contractor without estimate whereby their profession as an Electrical contractor in the state been adversely affected,” it added.


The firm has not completed the work but the major part of the electrical works has been completed as of date and only the external connection is left, NECU said.


It further maintained that Chief Electrical Inspector (CEI), Nagaland, had earlier informed the Director, Urban Development, Nagaland, Kohima “not to allow doing any electrification works other than by a registered electrical contractor.”


The CEI also stated that the electrical works are to be allotted only to the “bonafide holders of Identity Cards issued from Electrical Inspectorate,” the union said.


An order by the Commissioner & Secretary to the Govt. of Nagaland, Power department, Nagaland, Kohima dated 12.09.2007 had also stated that “the wiring work shall be carried out by an electrical contractor licensed on this behalf or recognized” by CEI, it added.


And on completion of the work, a Test Certificate by the electrical contractor shall be submitted to the Power Department while applying for power connection, NECU further noted.


“Section 45 of the Electricity Rules, 1956 of clause (2) provides - No electrical installation work which has been carried in contravention of sub-rule (1) shall either be energized or connected to the works of any supplier.”


The NECU had earlier submitted a representation to the concerned authority not to give clearance to energize for work ‘Re-Construction of Super Market Kohima” as per the norms and rules of the Indian Electricity.


The Union also noted that works of electrification carried out by a non-registered electrical contractor is “illegal and in gross violation of the petitioner’s legal constitutional rights as guaranteed under the Constitution of India and the Indian Electricity Rules 1956.”


In this regard, the NECU said that the “Union would fight till justice is meted out to the victims and the success of this fight would also amount to public welfare.”
