Prohibitory order under Section 144 (A) issued

Wokha, January 23 (MExN): District Magistrate, Wokha, Manazir Jeelani Samoon, IAS, in exercise of power conferred under Section.144/144A and specific directions of ECI Vide NO.464/L&O/2007/PLN-1 has issued an order prohibiting carrying of licensed arms, sticks, daos, explosives, (Like fire crackers) machetes.


All contesting candidates or their agents or political parties have also been prohibited from wall writing, pasting posters, papers or defacement in any form or erecting of cutouts, hoardings, banners in public property or public premises without due permissions of District Magistrate.


The use of PA/Loud Speakers system between 10 pm to 6am, carrying cash above Rs.50,000/- (fifty thousand) only by any person or persons, without valid documents, wearing of mask, hood or any other device prohibit by any person over 16 Years of age whereby, a substantial portion of face is hidden or covered so as to conceal the identity of the wearer, to be or appear in any public space or upon any private property without consent of owner/tenant thereof in writing have also been prohibited.


Whereas the emergent nature of the case and circumstances do not permit serving of notice upon the general public in due time and hence this order is passed ex-parte under Sub Section 2 of Sec.144 CrPC and is directed to the public of Wokha district in general.


This Order shall come into force within Wokha District with immediate effect till declaration of result.
The order has been issued in view of the announcement of Election schedule for the conduct of General Election to the 13thNagaland Legislative Assembly by the Election Commission of India (ECI), and after reviewing the prevailing Law and Order situation in Wokha District especially in view of current General Election, 2018. The order has also been issued to ensure no untoward incidents occur during the conduct of current General Election, 2018 and to ensure maintenance of Law & Order and prevent any kind of riot or affray in the district for ensuing peaceful, free and fair elections.


Phek: In view of the 13th Nagaland Legislative Assembly Election, 2018 and in accordance with the guidelines issued by the ECI regarding preventive action to ensure conduct of peaceful, free and fair poll during the elections and preservation of public peace and safety, District Magistrate, Phek, Shanavas C, IAS, by the power conferred by Section 144 (A) of the Criminal Procedure Code, 1973 has issued an order prohibiting the carrying of licensed arms/weapons within the jurisdiction of Phek district. However carrying of licensed arms for the purpose of verification at the nearest police station or depositing of the same and for uploading in the NDAL database has been exempted from the purview of the order.


This order will be in force with immediate effect till the completion of the election. The word ‘arms’ shall have the meaning assigned to in Section 153AA of Indian Penal Code, 1860.
