DIMAPUR, JANUARY 30 (MExN): The Court of Judicial Magistrate First Class, Dimapur District on Tuesday sentenced a man, convicted of rash and negligent driving leading to loss of a life, to one (1) year simple imprisonment. The accused was convicted u/S 279/338/304 A of the Indian Penal Code.
According to the court order, the accused identified as Md Malam Khan was driving a dumper truck towards Jharnapani through the wrong lance when it hit a scooty which was proceeding downwards in the right lane at NH 29, New Chümoukedima.
As a result, the rider of the scooty namely Tingthong was seriously injured and immediately evacuated to the community health centre, Medziphema. However, the victim succumbed to his injuries before reaching the hospital. An FIR was registered and the case was endorsed for investigation.
During the hearing, the defence counsel submitted that a compromise deed has been executed with the family of the victim and the accused is a first time offender. It therefore prayed that maximum leniency be shown to the accused.
Judicial Magistrate First Class, Khrievono Seletsu, however, observed that many precious lives have been lost due to accidents caused by rash and negligent drivers in Dimapur district. Even in the instant case, the accused driver was knowingly driving in the wrong lance fully aware of the consequences and had hence leading to the loss of an innocent life.
“Therefore considering the nature of the case and to deter any offender to commit similar crimes in future, this court do not deem fit to grant the benefit of probation to the accused…” the Magistrate stated while handing over the sentence.
