Gov directs NLA Speaker to summon special session for floor test on July 19

DMAPUR, JULY 18 (MExN): Nagaland Governor PB Acharya has directed the Speaker of the Nagaland Legislative Assembly to summon an emergent Special Session of the Nagaland Legislative Assembly on July 19, 2017 at 9:30 AM to test the majority support of the present cabinet led by Chief Minister, Dr Shürhozelie Liezietsu.  

This directive comes following the dismissal of the writ petition filed by Dr Shürhozelie Liezietsu on July 14, 2017 at Kohima Bench Gauhati High Court vide Judgment and Order dated July 18, 2017 as well as vacation of the earlier interim order passed by the same Court on July 14, 2017.  

The Governor in a directive to the NLA Speaker further stated that “the report of the proceedings/resolution of the house may be communicated to me forthwith and the House shall be adjourned sine die after conclusion of the business relating to the above agenda.”  

“Necessary notice to Dr Shurhozelie Liezietsu, Chief Minister and all Members of the House may be sent by email/electronic means and other emergent process admissible under the procedures immediately. They should also be intimated by telephone,” the Governor directed.  

The Governor also meanwhile informed the Speaker that the members of the NLA are at Kohima in connection with the presidential election.  

The Gauhati High Court, Kohima Bench had observed that the Governor had taken the right decision to ask the Chief Minister to have a Vote of Confidence in the floor of the House to see which out of the two contesting claimants of Chief Ministership had a majority in the House. The Court further stated that there was no merit in the writ petition filed by Dr Shürhozelie Liezietsu and the same was accordingly dismissed.  

Emergent NLA session today

DIMAPUR, JULY 18 (MExN): The Governor of Nagaland today summoned the 17th (Emergent Special) Session of the 12th NLA at 9:30amon July 19. The Commissioner & Secretary, NLA said that the session was summoned in exercise of the power conferred by Clause (I) of the Article 174 of the Indian Constitution. Meanwhile, the Additional Secretary, NLA has asked all AHODs/HODs/media persons and officials connected with the session to come in their official vehicles with their identity cards since no car passes and official gallery passes will be issued.    

NPF issues whip to its MLAs

DIMAPUR, JULY 18 (MExN): The office of the Whip for the NPF has issued directives to its MLAs that if any motion of confidence is moved by the CM, Dr. Shurhozelie Liezietsu in the emergent session of the NLA summoned on July 19, “all NPF Legislators shall and are hereby directed to vote in favour of the motion.” “If any motion is moved by anybody expressing no-confidence in the Council of Ministers headed by Dr. Shurhozelie Liezietsu, all NPF Party legislators shall vote against the motion,” the directive added. The directive was issued by Chief party Whip and Social Welfare Minister, Kiyanilie Peseyie. It further cautioned that NPF legislators disobeying the whip/directions of the party “shall be liable to be disqualified in terms of the Tenth Schedule of the Constitution of India.”
