Dimapur, July 29 (MExN): The ACAUT Nagaland along with the PSAN (Public Service Aspirants Nagaland) has filed a PIL in the Gauhati High Court, Kohima Bench, against backdoor appointments in the State.
Among the three issues raised in the PIL, the first has pleaded the Court to “Quash and set aside the appointment of 51 backdoor appointees appointed against NPSC posts; and since the appointments were made after the HC, Kohima Bench, had banned backdoor appointments- 6th June 2016 judgment, to treat such appointments as contempt of court.”
The second seeks the “Quashing of the Office Memorandums 4/8/2008 and 11/8/2016 which confers powers upon the government to regularize all backdoor appointments after 3 years of service which is in total contravention of the SC judgment as passed in Umadevi Case, 2006, which says that backdoor door appointment is illegal and ultravires of the Constitution.”
Third, the PIL sought from the Court to “Terminate the services of all 655 backdoor appointments made against NPSC posts, that is, appointed between the Umadevi judgment of 2006 and Gauhati HC order, Kohima, dated 6/6/16.”
Alternatively, it called for the “requisition all the 705 (655+51) posts to the NPSC for general recruitment through open competitive examination,” as well as to “submit the detailed status report of the 705 backdoor appointees before the Court.”
In a press release from its media cell, the ACAUT Nagaland noted that the 655+51 backdoor appointments made against NPSC posts are from a total of 35 departments. Some of the prominent departments are: Social Welfare (77 posts), RDD (57 posts), SCERT (74 posts), DG of Police (14 posts), Tourism (10 posts), Geology and Mining (10 posts), PWD (81 posts), Medical (138 posts), Higher & Technical Education (59 posts), Eco & Statistics (24 posts), Art & Culture (6 posts), Treasuries & Accounts list (8 departments, 36 posts) and AG list (16 departments, 70 posts).
The ACAUT and the PSAN conveyed that the Court has “stayed and suspended” the Office Memorandums dated August 4, 2008, and August 11, 2016, till the PIL is disposed off.
Further, the 51 backdoor appointees have been directed to appear before the Court as respondents. “Therefore, any department trying to appoint or in the process of regularizing posts will be held inContempt of Court,” informed the press release.
