‘Break the Silence’: NSHRC Chairman appeals for accountability in stalking

The Nagaland State Human Rights Commission (NSHRC), Chairman Justice Lanusungkum Jamir on Wednesday highlighted that under Section 78 of the Bharatiya Nyaya Sanhita (BNS), the Indian legal framework explicitly recognizes two primary categories of stalking including Physical Stalking and Cyber Stalking. 

Speaking at the State Level Awareness Program on “Prevention of Stalking & Cyber Stalking” organised by National Commission for Women (NCW) in collaboration with Nagaland State Commission for Women (NSCW), Justice Jamir deliberated on these two aspects of stalking 

He asserted that prevention goes beyond the courtroom, and requires a holistic societal and institutional shift. In this regard, he underlined that, “individuals must be educated on how to document and report repeated unwanted intrusions before they escalate into violence.”

Stating that the first crucial legal step in building a case is giving a clear, documented, and unequivocal “no” to the stalker,” he also underlined that preventing stalking begins with respecting personal boundaries and everyone has the right to feel safe and secure.

While the Indian legal framework has laid the groundwork to protect us, he however noted that the law alone is not enough, and urged that, “we must stand together, break the silence surrounding cyber stalking, and hold perpetrators accountable.”

Further stating that everybody has a responsibility to be respectful online, he advised the gathering to “think before you post, avoid spreading rumors, and never use technology to intimidate or harass others.” He said, “The internet should be a place for learning, communication, and positive connections-not fear.”

By staying informed, protecting our digital privacy, and supporting those affected, he also maintained that, “we can all play a role in preventing cyber stalking and making the online world safer for everyone.”
