Chief Justice of Gauhati High Court visits Phek

Phek, August 6 (DIPR): The Chief Justice of Gauhati High Court, Justice Madan B. Lokur accompanied by Justice A. K Goswami, Gauhati High Court Kohima Bench, was on a two day visit to Phek. On August 6 addressed a gathering in the DC’s conference hall. In his speech, the Chief Justice said that separation of power in the state of Nagaland has been put in place to some extend, however necessary effect should be given for full separations of power viz the executive, legislature and the judiciary. He said that it was the work of the court to interpret law because sometimes when the executive interprets law it may not be in justice.

There are two systems of law namely the codified laws, and traditional/customary laws and it is very important that both the systems go hand in hand, the Chief Justice stated, adding that customary laws are very important which should be encouraged and developed, because such justice is delivered promptly which represents and is accepted as the collective will of the people. Any matter which comes up should be settled by the people themselves through mediation and good will besides he said and encouraged the public to go for alternative dispute resolution. However, he stated that in cases of incorrect judgment the aggrieved can make an appeal to the higher court for getting justice.
He disclosed that the government of India under the 13th finance commission have earmarked Rupees 5000 crores under five year plan for developing of infrastructure and other related judicial works in the states. However he lamented that the government of Nagaland have not submitted or formulated any action plan for availing funds from the central government. He expressed his willingness to develop infrastructure in all the customary courts in the North-East, towards which he appealed to the law & justice department to prepare and submit an action plan in time for availing funds for infrastructures like office and staff quarters and other basic facilities like computer with internet connection. He observed that district headquarters like Phek, which has transportation problems, need to have facilities like video conferencing so that justice will be promptly delivered. Kiosks with internet facility has already been set up in Kohima High Court, therefore if proper technology is put up in the district then anyone can get an easy access seeking information regarding any case from the high court. Expressing his concern, he said that we should work both for speedy and quality justice, which should be responsive and just in order to give people what they want at the right time.
An interaction was followed his address. A short speech on behalf of the public was delivered by Chief Advisor, Phek town council, Shevotso Rhakho, while welcome address was delivered by Deputy Commissioner Phek, Mikha Lomi. The pogramme was chaired by Additional District & Session Justice Judge, Phek, Khape Koza, while a folk song was presented by DBs of Phek. The programme was also attended by Registrar, Gauhati High Court, Kohima bench, LN Sema, Joint Registrar Gauhati Court, Kohima bench, Chibasao Lotha, joint secretary Law & Justice, Nanjo, President of High Court Bar Association Nagaland, Timikha Koza, besides several other other officials.
