CIC directs PIO Roads & Bridges

KOHIMA, SEPT 3 (DIPR): The Information Commission in its decision Notice dated 5.7.07. had directed the PIO, L. Yezhekhu Sumi to appear before the Commission on 20.7.07. to show cause as to why he should not pay a penalty of Rs 250/- per day for each day of delay subject to a maximum of Rs 25000/-.

The PIO reported that the information sought had been furnished to the Appellant K.C. Angami President, (NGRC- I CU) free of cost on 6.7.07 as directed by the Commission and requested that he may be exempted from the penalties in the case. The Commission observed that most of the statements have been made during the hearing on 2.5.07 and discussed in the Decision Notice of 5.7.07. 

In another appeal filed by Holuto Aye, P.S. to MLA 33 Suruhuto Assembly Constituency, the PIO L. Yezhekhu has on 20.07.2007 appeared before the Commission and informed that the information sought have all been furnished to the applicant, as well as during the Assembly session. In view of the submissions made by the PIO, the Commission considered it necessary to have the following information before further orders are passed.

The RTI application 23.01.2007 was received in the office on 1.2.2007, and endorsed to the concerned branch, but information was not furnished within the prescribed period.

The Public Information Officer is directed to enquire who were the officials/staff responsible for holding up the RTI application received on 1.2.2007, fixing responsibility on each of such official/staff and submit his report/findings to the Commission within 10 working days. The Public Information Officer will inform the Commission where the mechanism has been set up and the office sensitized for dealing with RTI applications within 10 working days.

The Appellant Holuto Aye submitted to the Commission on 31st August that he was not satisfied with the information furnished to him relating to item No. 3 of his request. He was directed to put his dissatisfaction in writing.
