
DIMAPUR, MARCH 14 (MExN): Deputy Commissioner, Mokokchung has directed the Chuchuyimlang Village Council (CVC) to immediately revoke the orders of excommunication and banishment issued to certain members of its village.
A notice issued by the DC Mokokchung Sachin Jaiswal on March 13, 2018 to the CVC stated that it has received a complaint on the misconduct of the said village council which include excommunication of one Mangyang Lima from the village for a period of 11 years with effect from February 1, 2018 to January 31, 2030 for contesting in the general elections to the 13th Nagaland Legislative Assembly 2018.
Also, the village council had intimidated the supporters of the said candidate by imposing fine in the form of pigs on March 12, 2018. Further, the village council had also expelled its council members namely Yarensosang, Imkongsowa, Imtisunep, Limaakum and Tinumeren, for refusing to comply by the order imposed by the CVC.
The DC in the notice said such acts are unethical and illegal and goes against the constitutional provisions of a democratic state.
Further, the procedures to remove members of the village council has been prescribed under Rule 9 (i) (a) to (f) of the Village Council Act 1978, where the power to do so rest with the State Government and not with the village council, the DC pointed out.
It reminded that the village council is appointed and recognized by the government under Village Council Act 1978 and as such is an instrument of the government and therefore should abide by its rules.
In this connection, the DC has directed the CVC to revoke its orders of excommunication and banishment with immediate effect. The DC has cautioned that any failure of the village council to act positively and as per legal provision shall be a ground for dissolution of the council under Section 54 (1) of the Village Council Act.
