Apex Court dismisses another challenge to HC’s ruling

Giving finality to the May 27, 2025, verdict by the Gauhati High Court (GHC) Principal Bench concerning eviction proceedings on land designated for the expansion of Dimapur Airport, the Supreme Court has dismissed another Special Leave Petition (SLP) challenging the GHC’s ruling.

In its order dated July 8, the apex court bench comprising Justice Rajesh Bindal and Justice R Mahadevan referred to the earlier SLP that was dismissed on June 23 by a separate bench.

“It is not in dispute that SLP (Civil) No. 16691 of 2025 filed against the same impugned order has already been dismissed by this Court. The present Special Leave Petition is accordingly dismissed. Pending application, if any, also stands disposed of,” the order stated.

The SLPs were related to Civil Review Petition (CRP) No. 105/2024 and CRP No. 106/2024 filed by the State of Nagaland and its agencies, challenging earlier orders passed by the Civil Judge (Senior Division), Dimapur on November 22, 2021, which were upheld by the Principal District Judge on September 29, 2023.

These orders had restrained the State from carrying out evictions on land earmarked for the airport’s expansion.

However, in a common judgment issued separately for both petitions, the High Court on May 27 quashed the interim injunctions granted by the lower courts, thereby clearing the way for the eviction process.

Following the High Court’s ruling, an eviction drive was carried out on the ‘encroached land’ at Dimapur Airport on June 13.
