Disqualification petition against 7 NCP MLAs dismissed

The disqualification petition pending against the 7 NCP MLAs in Nagaland has been dismissed by the Speaker, Nagaland Legislative Assembly. The Sharad Pawar faction of the NCP had filed the petition after the 7 MLAs sided with Ajit Pawar, who rebelled against party supremo Sharad Pawar in July 2023 to join the Shiv Sena-Bharatiya Janata Party coalition in Maharashtra.

The petition against the Nagaland NCP MLAs was preceded by the Sharad Pawar faction petitioning the Election Commission of India, challenging the Ajit Pawar faction’s claim to the party nomenclature and symbol, on grounds of the latter indulging in anti-party activities.

The NLA Speaker came out with the ruling dismissing the disqualification petition against the 7 MLAs on February 16. As per the ruling, the dismissal of the charges was based on the ECI ruling in favour of the Ajit Pawar faction on February 6. 

It said that, per the decision of the ECI, supporting the “legitimate leader of the Political Party of NCP” did not amount to anti-party activities or voluntarily giving up membership of the party. As such, it said that proceeding with the case will be “infructuous” (unnecessary). 

Dismissing the petition, it said that the 7 NCP MLAs, namely— Er Picto Shohe, P Longon, Namri Nchang, Y Mhonhemo Humtsoe, S Toiho Yeptho, Y Mankhao konyak and A Pongshi Phom are not liable to be disqualified under Para 2(1) (a) of the Tenth Schedule of the Constitution of India.
