
Kohima, October 8 (MExN): The DoIT&C, Government of Nagaland has notified that the Telecommunications (Right of Way) Rules, 2024 (Rules 2024) issued by the Ministry of Communications, Department of Telecommunications, Government of India, shall be enforced in the State with retrospective effect from January 1, 2025.
The Rules 2024 have been formulated under the Telecommunications Act, 2023 and are mandatorily applicable across all States, the The Department of Information Technology and Communication (DoIT&C) stated in a notification.
The Rules 2024 aim to digitise, streamline, and expedite the Right of Way (RoW) approval process for telecom infrastructure, it added.
In compliance with the said Rules and as per the resolution of the State Broadband Committee (SBC) during its meeting held on February 11, 2025, the DoIT&C stated the Rules 2024 will prevail over any previous State guidelines.
Accordingly, any provisions contained in the earlier Guidelines for Granting Right of Way (RoW) for Installation of Telecom Infrastructure in 2019, issued on December 2, 2019, and its subsequent amendment dated September 30, 2024, that are inconsistent with the Rules 2024 shall be deemed superseded, the Department informed.
This is to ensure full alignment with the latest Rules notified by the Government of India, it added.
As per the State DIPR, all Departments and stakeholders have been directed to ensure strict compliance and to process RoW applications for telecommunication infrastructure exclusively through the mandated digital platform.
