HC Kohima Bench modifies earlier order on Wokha VCs issue

The Gauhati High Court Kohima Bench, on November 7, modified an earlier interim order passed by the Court on August 2, 2021 staying an order passed by State Home Department, dated July 10, 2021, approving the constitution of the newly elected/selected Village Council members (VCM) under the whole Wokha district for the period 2021 to 2026 

A single-bench of Justice Kakheto Sema vacated order on Monday, while hearing an Interlocutory Application filed by State Government as well as counsels for the different private parties involved in a writ petition concerning the selection of the VCM. 

During the hearing, the Nagaland Additional Advocate General (AG) submitted that the petitioners in the writ petition have prayed to “set aside and quash the newly elected/selected VCMs of Sani’s Village, under Wokha district.”

However, in the interim order, the election/selection of the entire VCMs under Wokha district has been suspended, the Additional AG pointed out, while urging for “modification/alteration of the interim order dated 02.08.2021.”

Likewise, the counsel for the “opposite party/petitioners” also conceded to the submission made by the Additional AG and stated that the petition filed by the petitioners is only to “quash and set aside the impugned approval of the newly elected/selected members of the VCMs of Sani’s Village.”

In view of the submissions and going through the records of the case, the Court agreed that the writ petition pertained only to Sani’s Village and not the whole village council under the Wokha district.

 According, Justice Sema modified the interim order and stated that it will be applicable only in respect of Sani’s Village Council and not the Wokha district as a whole.
