Kohima, July 3: The Guwahati High Court, Kohima Bench has stayed ordered issued by Menuovilie, chairperson Kohima Municipal Council against the tenants of Super Market, Kohima to vacate their rooms within three months.
It may be recalled that the KMC chairperson had issued an order to the tenants of Super Market, Kohima to vacate their rooms on April 5, 2007 on the grounds that it would be dismantled as the building is in a dilapidated state and on the verge of collapse. However, the Local Traders’ Union, Super Market, Kohima had challenged the order in the court expressing that the order issued by KMC was in contravention with the Memorandum of Understanding (MoU) signed between the State Government represented by Deputy Commissioner, Kohima and the Union on August 1, 2003.
The hearing on the matter took place in the Guwahati High Court, Kohima bench on June 29 last, wherein the court observed that the MoU was not signed between the KMC and the Petitioner’s Union and as such chairperson of KMC, Menuovilie had no power to issue the order.
Meanwhile, the MoU states that on completion of the new Super Market building, the competent authority would automatically allot rooms to the present genuine tenants who are actually running their shops and not defaulters in payment of house rent excluding the sub-letters.
