HC wants clarity on GB’s appointment and removal from Nagaland Govt

Kohima, August 12 (MExN): The Gauhati High Court Kohima Bench, on August 12, asked clarification from the Nagaland Government regarding the procedures for the appointment and removal of Gaonbura (GB) positions in the State.

Accordingly, Justice Kakheto Sema directed the Government Advocate representing the State respondents to provide detailed instructions on the procedure for both the appointment and removal of GB. 

Additionally, the Government Advocate was asked to present any relevant notifications or circulars regarding this matter. Similar orders were issued on July 4 and July 25, but the State has yet to submit the required information.

The case involves a writ petition filed in May 2022 by three Gaonbura from Tepun village in Peren district, challenging their termination by a common order dated December 3, 2021, issued by the Deputy Commissioner. 

The petitioners have also submitted then that no replacements have been appointed for their positions and the Court has placed an interim order that no one should be appointed to the posts they were appointed to till the returnable date. 

The interim still continues.  The case has been scheduled for next hearing in three weeks.
