Hearing on former Noklak DC’s transfer petition deferred to Dec 8

The court hearing on the transfer petition filed by former Deputy Commissioner of Noklak, Reny Wilfred has been deferred to December 8. The deferment was on grounds of ill health of one the counsels representing the respondents in the petition. 

An order passed by the Kohima Bench, Gauhati High Court, on November 22 stated that the Public Prosecutor was “indisposed as he has met a vehicular accident and therefore, submits that the matter may be listed on 08.12.2022.” 

While deferring the hearing to another date, the court noted the “matter involves urgency” and that all the parties are expected to endeavour to dispose the case in the next set date. The stay of the trial in the POCSO Court, Tuensang will continue till then.  

 

The transfer petition was filed by the former Noklak DC seeking transfer of his trial from the POCSO Court to another citing threat to his life and personal liberty and the “apprehension that he will never get free and fair trial in the POCSO Court at Tuensang as social media campaign is going on against him…”

He was facing trial under IPC Sections 354, 376, 511, read with Sections 8 and 10 of the Protection of Children from Sexual Offences (POCSO) Act in a sexual misconduct charge levelled against him by two minors during his stint as Noklak DC. The allegation, which was registered at the Noklak Police Station in August 2021, was subsequently taken over by the State Crime Police Station.
