Justice denied is justice delayed

A classic study using certain measurement techniques discovered three types of suicide, namely, Altruistic, Egoistic and Anomic. Each of these types of suicide speaks of a specific ‘condition’ of the society and victim. Let us stressed more on the ‘egoistic suicide’ as whole, the fact in this discussion speaks out the possibility of the high rate of egoistic suicide. What is egoistic suicide? Society and mankind often create certain situations which become intolerable for the individuals and he/ she feels isolated, hurt, humiliated and dehumanised. Hence, the urge for egoistic suicide found its place finally in the victim’s heart.

Such is the case of Miss Rose of Ngaprum village of Ukhrul district in Manipur, who committed suicide the day after she was raped by two army officers major Pundir and captain Negy of 95 border security force on the 4th march 1974 before the eyes of helpless village elders who were force to watch the ‘play’ at a gun point.

The reason, she mentions clearly in her suicide note express her feelings and the helplessness of the villagers. But it was not a mere suicide note when we can feel the situation , it was a message from a women who was raped and force to kill herself .she wish no longer to live in this world where there is so much injustice and no justice at all. As for her the injustice came to an abrupt halt, she cease to feel anything. For her, there may be promising justice in another neither world. No one knows, but what about the other victims who are still very much alive in this world? To those, women who were raped, parent and husband killed? Who are left with no government or society to give compassion? A living corpse still clinging on an empty hope to let the people know what is being done, forget about justice. The draconian law under the guise of Arm force special power act (AFSPA) implemented on 1972.

Who will give justice to the north eastern girls, who have been raped so far in Delhi and other states of India by the people who have been immune by the idea of this forces act, because of the long history in north east. It is true to say that the north east student and women, who reside in Delhi, have become an easy target for the rapist. What absolute justices have been given so far to them? The girl from Manipur put up in Munirka who was rape last year have been negotiated with some few thousands and now the recently rape case of the student from DU, which have died down after getting hold of one unnamed victim and an empty promise by the police of India.

There are innumerable army acts such as AFSPA which gives the army unlimited power over the people of north east and which cannot be allowed by a democratic country and people such as armed forces (special powers) regulation 1958, Nagaland security regulation 1962, Assam maintenance of public order (autonomous district) act 1953.it is an extra- constitutional and blatantly against all fundamental rights including the UN declaration of human rights which the government of India has agreed.

In 6-2-1982 sexual assault of women where army forcibly assaulting and forcing the to undress and plucked their own pubic hair as part of their enjoyment .Minor girls all below 18years of age were publicly molested and taken away to be released after nearly two weeks . Many minor face rape, torture and mass humiliation, leaving them mentally and physically maimed and over death. They did not even spare pregnant and old women whom they ought to touch feet and ask for blessing. In 1978 an old lady from kohima village, Nagaland narrate how a girl from Lotha Naga area was first rape then hanged upside down killing her by thrusting a stick on her private part. And a pregnant woman was shot in the legs after which a rope was tied round her neck and she was dragged around in public bringing her down such to a humiliation of a wild animal and dog. But still even dogs were treated not so badly by its master. Why then to a human being? That too while she is carrying her foetus? One is at lost to find words to describe their suffering; they were forms of repression used by the military and paramilitary of India of the Naga which excel the tyranny of Nazis to Jews. the execution in public, mass raping, deforming of sex organ, mutilating limbs and body, electric shocks, puncturing eyes, hanging people upside down, putting people in smoked room, burning down of villages, granaries and crops, concentration camps, force starvation and labour etc Many have been abducted those who return home have tales of ruthless torture. Since from 1950’s the Indian security forces have been carrying out their counter insurgency operation in north east Naga inhabited area till now, which resulted in the recent murder and rape case of Manorama Devi in Manipur. 

Among the various exploits of the Indian Army, ‘operation bluebird’ was the biggest in recent times. On July 9, 1987 the 29th battalion Assam rifle post near ‘Oinam’ village in Senapati district, Manipur was raided in broad daylight by the undergrounds. They walk away with huge quantity of arms and ammunition. Nine jawans (soldiers) were killed and three seriously injured. The Assam rifles launched ‘operation bluebird ‘to recover the captured arms and ammunition. The operation lasted till the end of 1987.it was carried out in and around Oinam and its surrounding of 30 villages where the army use the churches as concentration camps. hundreds villagers were severely beaten and subjected to third degree methods of tortures, men were hung upside down, buried alive and given electric shocks. Two women were forced to give birth to their babies in the open ground in full view of the soldiers (jawans) and the villagers. Those people either students or politicians who tried to reach the people in the villages were illegally detained to torture.

In order to invoke fear psychosis in children parents use to tell “go to sleep or the Sepoi (army) will come” instead of the olden phrase which is use as tiger or beast. I thought it was normal not to allowed to play with crackers as the army will shoot fire assuming that the undergrounds have again risen to attack them or to be at home before 4pm even thought you like so much to go out and play as normal kids play but this time the villagers did not remain silent they dared to speak out. They did not finally consider normal to be punished for no fault of theirs. With the help of Naga people movement for human rights (NPMHR) initiated  by Ms Nandita Haksar, an eminent Human rights activist and an advocate in Supreme Court dragged the armed forces to court. She filed dozens of affidavits of victims, memorandums, petitions, newspaper reports and other document running into almost 1,000 pages but still ironically the high court decided that there were needs of more evidence. Such paradox resulted in dragging and detaining the hearing. Finally on April 1992 after a vigorous circle in court the Gauhati high court appointed two judges namely – Justice Bhukan and Justice W.Shishak for final hearing and argument. Surprisingly after recording of overt 10,000 pages, brief of the argument, justice Bhukan was transferred before writing the judgement and Justice W. Shishak has retired. Since then in spite of several appeal, the case has been kept pending and no judge has been appointed nor listed for hearing till date.
