Law students make an appeal against ‘back door’ appointments

DIMAPUR, SEPTEMBER 1 (MExN): The Nagaland government has been caught in the wrong foot in a matter relating to “backdoor appointments” by none other but students demanding justice, who also have a grasp of the law.

The Nagaland Law Students’ Federation has learned that the government is contemplating to regularize the services of contract/casual employees in violation of Nagaland Secretariat service rules, “and related to OM issued by the P & AR vide no. PAR 5/1/84 dated 23/04/ 2001,” which clearly states that such recruitment should be made through NPSC.

The Supreme Court has also laid down that appointments made in violation of Procedures laid down under Article 14, 16 and 309 of the Constitution are deemed backdoor appointments.

“Such action on the part of the Government… is in violation of the Fundamental Rights of citizens who are deprived of the chance to compete and be selected according to merit. As a student’s organization it is our right to challenge such illegal actions of the Government as it is the students who are the ones deprived of the chance and right to compete and to employment.”

“Under the circumstances it is respectfully requested that the move to regularize the casual/ contract appointments be immediately stopped and the post in question be advertised through NPSC and every interested citizen be given a fair chance to compete for the appointment against the said post. It is needless to say that in the event regularization is granted to the contract/ casual appointees, we as interested parties shall be compelled to challenge the said post regularization in an appropriate court of law.”
