Local court restrains Rio from opening office using NPF name

DIMAPUR, AUGUST 14 (MExN): A local court has passed an interim order restraining MP Neiphiu Rio from using the name of Naga People’s Front (NPF), its symbol and flags and also against the opening of any office using the name of NPF party.  

A press statement issued by Media & Press Bureau, NPF, Central Headquarters, L Yanlong informed that President of the NPF Mon Division (plaintiff) had filed a civil suit in the court of the Civil Judge (Senior) Division at Mon submitting that the MP to Lok Sabha Neiphiu Rio (defendant) has been appointed as the “Interim President” of the NPF on July 31, 2017, by a group of expelled and suspended legislators of NPF and had opened an office at Hotel Legacy, Kohima, using the name of NPF and its symbol and flags.  

The basis of the contention was that there is no post by the name and style of “Interim President” as per the Constitution of the NPF and that any official post of the party will have to be appointed by the General Convention of the party as per para-2 (c) of Article IV of the Constitution of the NPF party.  

As per the contents of the copy of the order which was made available to the media, Inalo Zhimomi, Civil Judge (Senior) Division Mon, who heard the case, responded that he was satisfied that the plaintiff had made out a case for grant of ad-interim injunction and accordingly passed the order restraining the defendant Neiphiu Rio from using the name of NPF, its symbol and flags. The order further restrained the defendant from opening of any new office using the name of NPF party till the next returnable date which has been scheduled for September 27, 2017.  

Noke Wangnao questions filing of suit

Chairman, DAN and Advisor to PHE, Noke Wangnao has termed it absurd that a learned advocate and spokesman of the NPF party, Achumbemo Kikon would travel all the way to Mon to file a case against the interim president of the NPF, Neiphiu Rio.  

While not undermining the wisdom of the Civil Judge (Senior) Mon Division on the interim order, the DAN chairman in a press statement however could not speak the same for the NPF party spokesman.  

By going to Mon to obtain interim order from the Civil Judge, Mon Division, Achumbemo Kikon has exposed his ignorance on litigation and has demeaned the judiciary mechanism in the state capital, Wangnao stated.  

The DAN chairman maintained that since the case in question pertains to Bayavu Hill Colony, Kohima, the case could have been conveniently taken up in Kohima High Court or the Magistrate court.
