Nagaland Govt notifies on quota implementation

Kohima, April 16 (DIPR): In supercession of the Department of Personnel and Administrative Reforms, Nagaland Notification No. RCBT-5/87 (Pt-II) dated 23rd July, 2008, the Governor of Nagaland, in exercise of the powers conferred by Articles 16(4) of the Constitution of India, has directed that 25% of all categories, both gazetted and non-gazetted posts, under the Government of Nagaland shall be reserved for the persons belonging to the following 6(six) Tribes of four districts of Mon, Tuensang, Kiphire and Longleng, with immediate effect. The tribes listed for 25% reservation include Konyak, Phom, Sangtam, Yimchunger, Chang and Khiamniungan.
Further, 12% of all categories, both gazetted and non-gazetted posts under the Government of Nagaland will be reserved for the following Tribes in the proportion indicated alongwith. The percentage, of posts reserved for the two tribes of Chakhesang and Pochury inhabiting Phek District will be clubbed together, as indicated. As such the allocation will be  Chakhesang/Pochury: 6%, Zeliang: 4% and Sumis of Kiphire District: 2%.
In order to ensure due representation of all backward tribes in various services, two sets of new Roster point tables have also been introduced with immediate effect. Each set contains two rosters one for those posts where reservation for physically handicapped/persons with disability is applicable and the other roster for those posts where the same is not applicable. The first set of roster tables (Annexure A-1 & A-2) will be applicable to categories of posts where 100 % of the posts (Non-Gazetted) are reserved for indigenous inhabitants.
The second set of roster tables (Annexure B-1 & B-2) will be applicable to categories of posts where 80% of posts (Gazetted) are reserved for indigenous inhabitants. Annexure-A-l & B-1, are for those categories of posts where there is no reservation for physically handicapped where’s, the Annexure A-2 & B-2 are for those categories of posts where there is 3 percent reservation for physically handicapped. These Rosters are to be repeated in a continuous process once the cycle is completed.
If no candidate is available from a particular BT whose turn has come on the roster, the benefit may be extended to the next Backward Tribe as indicated in the relevant roster. However, this benefit will be extended to the same tribe in the subsequent recruitment year, and if the second chance is not availed due to lack of suitable candidates, it will lapse. At the same time, the particular Backward Tribe which gained during that recruitment year will not be entitled to the benefit of reservation in the next recruitment, until their normal turn comes again in the roster.
In the event of non-availability of suitable candidates from amongst all the 10 (ten) notified BT for any single recruitment, the reserved vacancies shall be automatically treated as de-reserved and the same filled up from amongst the other indigenous tribes on the basis of merit.
Similarly, the vacancy reserved for handicapped candidates will be taken to the next recruitment in case of absence of qualified candidate from that category when their turn comes in the roster. The earmarked quota for the physically handicapped will go to the indigenous inhabitant candidate in the event of no physically handicapped candidate. However, if the second chance is also not availed, then the reservation will lapse till their terra comes again in the roster.
All BT/Handicapped candidates, to be eligible for appointment against the reserved posts should also meet the minimum required standards set by the recruiting authority. There will be a separate roster for each different service, and each roster shall start with different tribes, so that the benefit of reservation is equitably shared by the backward tribes. e.g. for the NCS, the Konyak tribe will open the roster and Phom will open the NPS post and so on if there are large recruitments in one examination.
The new Roster will replace the old roster with immediate effect and all appointments henceforth shall conform to the new roster system. In order to adjust for the appointments already made against the all roster, the filling of new vacancies will start from the vacancy point in the new roster corresponding to the vacancy point after the last vacancy point that has been filled up as on date. However, in addition the vacancy points in the new roster may not exactly correspond with the old roster as far as the backward tribes (BT) reservation points are concerned.
In order, therefore, to make further adjustment in the new roster, the appointments already made against each tribe for the BT reserved posts/vacancy may be marked on the new roster and the filing of new vacancies may start from the vacancy point immediately after the last marked BT reserved vacancy. Further, all the Departments should maintain a separate Register for effective implementation of reservation for the Backward Tribes.
