Nagaland Govt seeks 4 weeks to publish State Mental Health Rules

The Senior Government Advocate representing the Government of Nagaland and related entities today sought four weeks’ time from the Gauhati High Court Kohima Bench to publish the State Mental Health Rules framed under Section 121 of the Mental Health Care Act, 2007 in the Official Gazette. 

The Court was hearing a Public Interest Litigation (PIL) filed in July 2021, which, among other things, sought a direction to the State Government to constitute the Mental Health Authority as per the provisions of the Mental Health Care Act 2017.

Accordingly, listing the matter for further hearing after four weeks, the Division Bench of  Justice Kakheto Sema and Justice Budi Habung directed the  Senior Government Advocate to  come with necessary instructions as to the appointment of the personnel for the Mental Health Review Board. 

Meanwhile, hearing another PIL, the Division Bench also directed the counsel representing the Principal Director, Department of Health and Family Welfare, Nagaland to apprise this Court on the appointment of new Mission Director.
