NIC directs show cause to deptt of Works & Housing

KOHIMA, JULY 6 (DIPR): The Nagaland Information Commission has on July 5, ‘07 directed the PIO of Office of the Chief Engineer, PWD (Roads & Bridges) to furnish the information sought by the Appellant, K.C. Angami, with regard to information related to supply and construction works allotted under the Department w.e.f January 2006 up-to date.

The Commission directed the PIO to furnish all necessary information free of cost within 10 (ten) working days from the date of pronouncement of this decision i.e. July 5, ‘07.

The matter was heard by the full Commission on May 2, 2007 and the Commission found that PIO of the Department had not furnished any information to the applicant in response to the application dated 28.8.06 within the given period of 30 days. The information sought by the appellant should have been furnished within the prescribed 30 days by 28.9.2006 under section 7 (1) of the Act.

As per section 20(1) of the RTI Act 2005 penalty is to be charged at a rate of Rs. 250/- per day, starting from the completion of 30 days from the date of receipt of the original application till the actual date of providing the information subject to a maximum of Rs. 25,000/-

Hence the PIO has been directed to appear before the Commission on July 20, ‘07 (Friday) at 11 a.m. in the Zonal Hall, Kohima to show cause as to why he should not pay a penalty of Rs. 250/- per day for every day of delay in furnishing the document sought to the appellants.

In another case, the Commission on July 5, ‘07 has directed the PIO of the same Department to furnish the documents sought by the Appellant, Holuto Aye, P.S. to MLA 33 Suruhuto Assembly Constituency, Nagaland with regard to Construction/Maintenance of ‘Yehenu-Asuto Aghunato PWD Road under 12th Finance Commission.

Under Section 18 of the Act, the Commission has taken up the complaint and the matter was heard on 2.5.07.

The commission noted that the documents/information requested by the appellant was not furnished within the prescribed time frame and directed the PIO of the concerned Department to furnish the documents to the applicant free of cost within 10 (ten) working days from the date of pronouncement of this decision i.e. July 5, ‘07.

The PIO is also directed to appear in person before the Commission on July 20, ‘07, at 12 noon in the Zonal Council Hall Kohima, to show cause as to why he should not pay a penalty of Rs. 250/- per day for every day of delay in furnishing the documents to the applicant, subject to a maximum of Rs. 25,000/-.

Both the decisions were pronounced in open proceeding on July 5, ‘07.
