One sentenced to 10 yrs for possession of ganja

DIMAPUR, APRIL 3 (MExN): The Special Judge (NDPS) Phek, Ajonba Imchen, NJS has convicted and sentenced one Pfonyi to undergo rigorous imprisonment for a term of 10 years and pay a fine of Rs 1, 00,000 under section  20(b) (ii) & (c) of the NDPS Act. 

A press release from Samuel Ritse, Public Prosecutor, Phek informed that the Judge while passing the judgment pointed out that, “it is settled law that once the possession is established, the person who claims that it was not a conscious possession or have no knowledge of concealment has to establish it, so is presumption. Once possession is established, the court can presume that the accused had culpable mental state and have committed the offence.”

The judgment also read that, “From the prosecution evidence it is clear that the accused person was in possession of contraband ganja weighing commercial quantity of 360 kilograms from the vehicle that was driven by the accused.”

The case was investigated by UBSI Seyielhouca Kehie and Samuel Ritse, Lead Public Prosecutor led the prosecution.
