Rio educational qualification case hearing:

Complainant to file objection to transfer petition

A hearing on the educational qualification case of former Chief Minster and current MP Neiphiu Rio was held at the District & Session Court, Kohima on July 14. The hearing was on the application submitted by the petitioner under Section 408 CrPC for transfer of Criminal Complaint pending in the court of Mezivolu T Therie, CJM Kohima.  

In an order dated 27/06/16 issued by the District & Session Judge, Kohima, the petitioners had submitted that if the “complain case no 1/2016 is taken up in the court of the CJM, there is apprehension that fair proceeding would not be possible as the trail Magistrate is the sister-in-law of K. Therie, President NPCC.”  

The District & Session Court had stayed the proceedings of Criminal complaint case pending before the Court of CJM, Kohima and issued notice to the opposite (complainant) party for hearing on July 14, 2016.

  At the hearing today, Counsel appearing for the complainant asked for three weeks to file objection to the transfer petition and the stay order. Accordingly, the next hearing on the case has been fixed on August 12, 2016.  The Judge for the hearing was District & Session Judge, Y. Maongkaba Imchen.
