State Government to regulate highways

KOHIMA, AUGUST 6 (DIPR): To check and prevent rampant encroachments and disturbances on the highways in Nagaland, the Government of Nagaland ha reiterated the rules and guidelines protecting the highways in the State. The Government has decided that it would strictly enforce the rules and regulations in this regard in the interest of the public as a whole.
And in exercise of the power conferred by Sub Section (1) of Section 21 of The Nagaland Highways Act, 1967, the Commissioner & Secretary to the Government of Nagaland, Works & Housing Department, Temjen Toy in a notification dated 6th August 2011 stated that as the Highway Authority, for the purpose of restriction of ribbon development along highways, for the prevention and removal of encroachments and for all matters necessary and incidental to any or all of the above proviso of this Act, hereby order and re-affirm that, no person shall, without the previous permission in writing of the Highway Authority:-
•    Construct, form or lay out any means of access to or from a highway, or
•    Erect or re-erect any building or structure or make or extend; or
•    Materially alter any existing building, or
•    Make or extend any excavation; or
•    Construct approach/link roads, form or lay out any works or upon land between the highway boundary and the building line determined in respect of the Highway Act; or
•    Quarry or excavate along the road side or alter the level of land by lowering, raising, digging, or filling up or construct; or
•    Lay out any means of access to or from the highway, upon land lying in between the building and the control lines determined in respect of the highway; or
•    Make encroachment on any road, street, path, way or land which is declared to be a highway under Section 6 of the Act; or
•    Dumping of earth and garbage.
Further, the Commissioner & Secretary ordered that whosoever occupies or makes any encroachment on any highway in contravention of the provisions of Sub-Section (1) of section 21, or fails to comply with the notice and order served on him under Sub-Section (1) of Section 23 for no valid reason or obstructs any persons or fails to supply any information, or withhold such information, or gives information which he knows to be false, or which he does not believe to be true, shall, on conviction, be punished with penalties and fine, and shall also be summarily evicted from the highway land by the Deputy Commissioner or any officer authorized in this behalf by the State Government, or in any other manner as may be prescribed in the Act.
