All the doctors in Nagaland have been detached and being posted to their respective places, the Guwahati High Court, Kohima Bench was informed on September 28.

An affidavit to that effect has already been filed, informed the counsel representing the Principal Secretary & Principal Director Health and Family Welfare Department Nagaland; District Task Force Headed by the Deputy Commissioner and Chief Medical Officers of All Districts.

The Counsel further submitted before the Division Bench of Justices LS Jamir and Songkhupchung Serto that the other medical personnel have also been detached and sought some time to place those orders before this Court.

Allowing the submission, the Bench, currently hearing a Public Interest Litigation (suo motu) on health related issues and COVID-19 listed the matter for hearing again on October 10.

Earlier on August 29, the DHFW, Nagaland informed the Court that Government has already issued a notice asking for ‘submission of names of officers, apart from the Doctors, who have not joined their duties after the Attachment Order issued by the Department.’

“Other medical professionals like technicians, nurses etc shall also be included in the aforesaid Attachment Order,” the Counsel for the Department then stated..

It must be noted here that on April 20, another Bench comprising of Justices  Serto and Nelson Sailo, had directed the Principal Secretary, Directorate of Health and Family Welfare to submit an “affidavit explaining as to why no medical personnel are posted at some of the medical centres.”

It further directed the Principal Secretary to explain why medical personnel including doctors are attached elsewhere than their place of posting in the affidavit.
