Kohima, June 23 (MExN): The All Nagaland School Teachers’ Association (ANSTA) has stated that the posts of 1166 Adhoc Teachers are all grade three posts and should not fall under the purview of NPSC recruitment norms. “These posts are to be appointed within the department as per the service rules of the concerned department (Direct appointment can be made for the posts as per the services rules of the concerned Department).”
This was one of the points of observation of the ANSTA on the present ‘deadlock’ between the Government of Nagaland and Ad-hoc teachers regularization. These observations were submitted to the joint meeting of the Department of School Education (DoSE), ACAUT, PSAN and Adhoc Teachers on June 21. The document was released to the media today by ANSTA President, Ponchulo Wanth, and General Secretary, Visato Koso.
The list of observations noted that the ACAUT & PSAN Writ Petition no.145 (K) 2017 has been filed against the backdoor appointment of 706 posts in 35 departments which were supposed to be recruited through NPSC as per recruitment policy.
As per the existing recruitment rules, stated the ANSTA, the resultant vacancies of the aforementioned posts are to be advertised first and then recruitment be made through NPSC. However, “in violation of Govt. standing recruitment procedures, the resultant vacancies had been filled up through backdoor means without advertisement,” it informed.
Based on this, the ACAUT & PSAN filed the case against the practice of backdoor appointments and asked for termination of the appointment by requisitioning the posts to the NPSC for recruitment.
“The said case has impleaded only those posts which are to be requisitioned to the NPSC for recruitment through advertisement, particularly the Gazetted Posts,” the ANSTA observed.
As per Government Notification Dated Kohima, August 30, 2011, Amendment of Regulation 15(i) Clause (ii) states that "this Regulation is not applicable to recruitment to the posts of Stenographer, Police, including Police under Vigilance Commission and School Teachers, for which posts the Department concerned will follow their respective rules/procedures.”
Thus, the ANSTA concluded that the “posts of 1166 Adhoc Teachers are all grade three posts and should not fall under the purview of NPSC recruitment norms.”
The Association also reiterated that “Time and again ACAUT & PSAN has made their stand clear that W.P No 145(K)/2017 has not impleaded the School Teachers in any manner since they are outside the purview of NPSC recruitment norms.”
The ACAUT & PSAN (Petitioners) have “not made school teachers as the respondents to the said court case,” and thus, “school teachers are free from the clutches of the ACAUT & PSAN court case.”
Besides, ANSTA informed, the ACAUT & PSAN’s letter dated November 11, 2017 to the CM and Cabinet had asked them to drop Agenda No.10,16,22,23,26,27,& 39 in the Cabinet meeting, held on the same day at the Chief Minister Office, since the matter contained in the aforementioned agendas are in the court and interim order dated July 28, 2017 had stayed the same.
“However, the petitioners have not asked the authorities to drop agenda No.42 pertaining to regularization of 1166 Adhoc teachers as the issue is not impleaded in the said Court case,” observed ANSTA.
Hence, the Association requested a competent authority to move an Interlocutory Application (IA) before the High Court on the basis of the above mentioned facts and circumstances “so as to modify the Interim Order dated July 28, 2017, of W.P No 145(K)/2017 by relaxing 1166 Adhoc teachers from the said case.”
The ANSTA acknowledged that the “considerate view of the Sr. Additional Advocate General, Nagaland in his letter dated Kohima, the May 17, 2018 also hinted the possibility to modify the said Interim Order in favour of ANATG.” Finally, the Association requested the government to “kindly move the IA through a Fast Track Court in view of the gravity of the situation."
"Around 1100 Adhoc Teachers including Nursing Mothers have started their agitation at DoSE for regularization of the service since June18 without attending school duty which is adversely affecting the academic activities of government school students in Nagaland.”
