Authorities impose Section 144 of CrPC across Nagaland state

Dimapur, April 18 (MExN): In view of the General Election to the 18th Lok Sabha, 2024 from Nagaland Parliamentary Constituency scheduled to be conducted on April 19, the respective district magistrates in exercise of the power conferred under Section 144 of CrPC have imposed restrictions. 

The campaign for General Election to Lok Sabha, 2024 is prohibited before 48 hours of closing of the poll day i.e. from 4:00 pm on April 17. However, door to door campaigns during said period of 48 hours may be allowed with prior permission from DEO/AROs of the Assembly Segment.

Therefore, in order to conduct the scheduled General Election to Lok Sabha, 2024 in free, fair and peaceful manner, the provision of section 144 of the CrPC-1973 prohibits the following: Assembly of five or more persons within the district; movement of persons with arms/carrying of weapons; holding of public meetings; shouting of slogans and using loud speakers; acting in any manner detrimental to public peace and tranquility in the district.

The restrictions shall not be applicable to district administration, police, security forces, law enforcement agencies, emergency services, personnel/vehicles on election duty. All the political functionaries and party workers from outside the constituency and who are not voters of the constituency shall leave the constituency immediately after the campaign period is over.

Mon: District Magistrate, Mon, Ajit Kumar Verma, IAS issued various instructions, vide Standard Operating Procedure for last 48 hours to restrict the Assembly movement of people by invoking the provisions of section 144 of CrPC-1973. “Any violation of this order is prohibited by legal action under section 188 of IPC and other relevant provisions of the Election laws. This order is passed ex-parte  U/S 144 (2) CrPC-1973 and shall come into effect from 4:00 pm on April 17 and remain in force till April 20 in the entire district of Mon,” the DC stated.

Kiphire: DC & District Magistrate, Temsuwati Longkumer NCS, Kiphire in exercise of the power Conferred upon him U/S 144 CrPC of 1973 has prohibited assembly of five or more persons and vehicular movement of non-essential nature under Kiphire District. This order is passed ex-parte and shall come into effect immediately and will remain in force till April 20 at 6:00 am.

Noklak: DC & DEO Noklak, in exercise of the power conferred under Section 144 of CrPC has prohibit assembly of 5 or more persons in the district; movement of person(s) with arms and holding of public meetings. The restrictions shall not be applicable to District Administration, Law and Enforcement Agencies, Officials on Election duties, Vehicles on Election duty and Emergency Services. This order shall come into immediate effect from 4:00 pm of April 17 and shall remain in force up to 6:00 am of April 20.  

Peren: DC & District Magistrate Peren, Vineet Kumar in exercise of the powers conferred under Section 144 of CrPC of 1973, and in order to take precautionary measures to prevent occurrence of any untoward incidents in the interest of maintaining peace and tranquility in the area comprising of 6-Tening AC and 7-Peren AC, has prohibited assembly of five or more persons and vehicular movement of non-essential nature w.e.f 5:00 pm of April 17 till 5:00 am of April 20 in Peren district.  Any person violating this order shall be prosecuted under relevant Section of the Law and as the notice cannot be served individually to all concern, this order has been issued ex-parte, it stated

Tuensang: DC and DEO Tuensang A Zibenthung Kithan, NCS in exercise of the power conferred under Section 144 CrPc, 1973 has imposed prohibitory order. “In view of urgent circumstances, this order is passed ex-parte and shall come into effect from 4:00 pm on April 17 and remain in force till 5:00 am of April 20 in the entire District of Tuensang,” it stated.

Longleng: DC & DEO Longleng has notified that as per Section 126 of the Representation of the People Act 1951, any person who contravenes the stated provision shall be punishable with imprisonment for a term which may extend to two years, or with, fine or with both. However, the stated restriction may not be insisted upon those office bearers of political parties who are in-charge of our State. Such office bearers shall declare his/her place of stay in the State Headquarter and his/her movement during the period in question.
Phek: DC & DEO Phek, John Tsulise Sangtam, NCS has notified for general information of all political parties under Phek District Section 126 of the Representation of the People Act 1951 has been imposed in the district. Any person who contravenes the provision under the Act shall be punishable with imprisonment for a term of which may extend to two years, or with fine, or with both.

Zunheboto: In exercise of powers conferred upon, U/S 144 CrPC of 1973, Deputy Commissioner (District Magistrate) and DEO, Zunheboto Rahul Bhanudas Mali (IAS) has prohibit an assembly of five or more persons and vehicular movement of non-essential nature w.e.f the issue of this Order from 4:00 pm, April 17 to 19, 5:00 pm in the areas comprising of 31 Akuluto AC. 32 Atoizu AC, 33 Suruhoto AC, 34 Aghunato AC, 35 Zunheboto AC & 36 Satakha AC under Zunheboto District.
Further, in the area of the DC Office Complex and 100 meters in its vicinity including the Zunheboto public ground, Assembly of five or more persons shall be prohibited at all times till further orders. However, this does not restrict house to house visit during 48 hrs in connection with door to door campaigning, it stated.
