Delhi High Court dismisses petition to stop use of EVMs

Dimapur, August 5 (MExN): The Delhi High Court on August 3 dismissed a writ petition filed in public interest seeking use of ballot papers in elections and the discontinuation of the use of EVMs. 

Chief Justice D N Patel and Justice Jyoti Singh said the petition by lawyer C R Jaya Sukin was a publicity interest litigation based on hearsay and baseless allegations and averments.

The High Court in its reasoning cited the lack of any material or averments contained in the petition that justify the prayers sought. The Court further stated that there is no material to justify interference with the satisfaction of the ECI and Parliament as per Section 61-A of the Representation of People Act, 1951 in relation to EVMs. The petition was dismissed with costs of Rs 10,000.
