Sub: MEMORANDUM FOR SEEKING JUSTICE FOR THE BRUTALAL MURDER AND RAPE OF GORKHA WOMEN/GIRLS & ALSO OF OTHER COMMUNITIES IN THIS REGION & APPEAL FOR HIGHEST PUNISHMENT TO CURB THE MENACE :
Sir,
With due respect & humble submission, we on behalf of the Dimapur Gorkha Union would like to state the following for your kind & sympathetic action for the welfare & well being of the women folk of our community and also of other communities in this region.
That Sir, the following are the recent 4 (four) incident of heinous crime against women and to our community are stated below:-
1. Rape and brutal murder of Smt. Meena Rai,(Widow) aged 46 years at Medziphema on 2nd November 2012, where one illegal immigrant Bangladeshi Mohammad Saidul Alam is involved. He is arrested and under custody of Judiciary.
2. Rape of minor girl (4 years) old on 25th Dec 2012 (Christmas Day) under Senapati Dist., Manipur State in Tongpanj Village bordering Peren Dist., Nagaland. The culprit is Mr. Raju Soren who was under the custody of South PS Kohima, Nagaland and handed over to Senapati Police, Manipur for further trial and investigation. The girl victim was admitted at Oking Hospital, Kohima, Nagaland.
3. Rape of a girl aged 12 years, a student of Class-VI at Naginimora, Mon Dist., Nagaland on 1st Januray 2013 (New Year Day). The culprits were arrested and under custody.
4. Brutal murder of wife Sundari, a Mother of 3 children at Para Medical Colony, Kohima, Nagaland on midnight of 3rd January 2012 by his own husband Mr. Abdul Salim Ali, 40 years.
That Sir, as you are much aware of various crime against the women folk and also the inhuman rape of minor girls in India. The recent horrific rape of on 16 December 2012 a female physiotherapy intern was brutally beaten and gang raped in Delhi in a moving bus. She died from her injuries thirteen days later while undergoing emergency treatment in Singapore for brain and gastrointestinal damage. There are many cases un-reported due to social stigma in India
The Sexism, sexual harassment, rape and other crimes against women are problems faced by women in India. Though Indian law provides protections to women, certain local law enforcement personnel are reportedly negligent, downplay complaints and blame the victims for their clothing or imagination, and pressure victims to discourage them from registering legal complaints. There have also been cases of harassment and rape by police themselves. Even in cases of registered legal complaints, lack of follow-up inquiries and proper investigations results in poor prosecution, that often further discourages other victims.
Some commentators blame this underlying social context, and call for police and legal reforms. Protestors also specifically cited the sex crime rate statistics in Delhi, the highest among Indian cities, and more than the next five cities combined. Police figures show a rape reported on average every 18 hours; reported rape cases rose by nearly 17 percent between 2007 and 2011.Between December 16 and January 4, 501 calls for harassment and 64 calls for rape were recorded by the Delhi Police, but only 4 were followed up by inquiries. This scenario is horrifying the people and speacially the women folk.
That Sir, we still remember your speech on the day of Acceptance Speech after the Swearing-in Ceremony at New Delhi on July 25, 2012 and becoming the President of India, where you said “Our national mission must continue to be what it was when the generation of Mahatma Gandhi, Jawaharlal Nehru, Sardar Patel, Rajendra Prasad, Ambedkar and Maulana Azad offered us a tryst with destiny: to eliminate the curse of poverty, and create such opportunities for the young that they can take our India forward by quantum leaps.” {But when our young girl are raped and murdered, how could we eliminate the curse of poverty and take our India forward by quantum leaps??}.
So, the Dimapur Gorkha Union which is a NGO working for the welfare of the Gorkha Community in Nagaland and also for social harmony and peace in our state of Nagaland, urged the highest authority of India to amend the Laws & Constitution of India to safeguard the women folk and make a stringent Law to deal with the crime & atrocities against the women.
We demand the highest & capital punishment of the rapist by hanging till death of the culprit and also adequate compensation to the victim.
