Double jeopardy for visa offence: Nigerian national to be freed today

Morung Express News Dimapur | November 22   Nigerian national, Nweze Raymond Chinenyeuba, who has been languishing in Dimapur jail since September 7, 2016 over a visa offence will finally be released on November 23.   Chinenyeuba was detained at New Field Check Post in Dimapur on September 7, 2016 while travelling to Imphal from Guwahati on a night super with his friends as he could not produce his original passport.   According to reports, the Dimapur Chief Judicial Magistrate (CJM) court sentenced him to simple imprisonment of eight months and 17 days for contravention of the Foreigners Act, 1946, after examining the charge sheet filed by the police.   He completed his prison term on May 25, 2017. The Dimapur CJM court subsequently ordered his release. However, he was still confined in the jail for the last 17 months as the Nagaland Home department was awaiting deportation order from the Centre.   In a turn of events, one S Solomon Shaikh, a Dimapur-based citizen, approached the MHA and MEA, through representations, seeking Chinenyeuba’s deportation order. He also filed a habeas corpus petition before the apex court on the Nigerian national’s behalf on September 6, demanding immediate release and deportation of the latter to Nigeria.   The Nagaland Home Department finally received clearance from the Union Ministry of Home Affairs (MHA) on November 12, 2018 for deportation of Chinenyeuba to his native country.   It is also learnt that Tovihoto Ayemi, Advisor, Nagaland Power Department had agreed to bear the airfare for Chinenyeuba to return to his country on request.   Thanking Ayemi for extending humanitarian assistance to Nigerian National Raymond "with flight tickets from Dimapur till Lagos. Tomorrow he will be a free man,” Shaikh tweeted on Thursday.
