Nagaland: Committee constituted to suggest policy for contingencies, fixed pay employees

A committee has been constituted by the Nagaland Government to work on various options and suggest a suitable policy for regulating remuneration and terms of service for contingencies and fixed-pay employees, as informed to the Gauhati High Court Kohima Bench on June 11. 

The Department of Personnel Administrative Reforms, Nagaland, issued a notification regarding the same on February 16, 2024, submitted the Nagaland Government Advocate to Justice LS Jamir during a writ petition hearing on Tuesday. 

The Government Advocate further informed that the committee is presently addressing the matter and urged for three weeks' time to enable her to receive instructions. 

Accordingly, the judge directed the matter to be listed again for hearing after three weeks.

As per the court's records, the petitioner filed the petition in 2022, citing an earlier judgment order dated 03.03.2021, which directed the respondent authorities to consider the petitioner's representation for the grant of a minimum scale of pay.

Acting upon the judgement, the respondent authorities rejected the representation by order dated 16.04.2021, citing the absence of a Government Policy for granting a minimum scale of pay to Work-Charged, fixed-pay employees.

However, the petitioner contended that in similar matters, the Kohima Bench on 24.09.2018, had passed similar direction, and in pursuance of that, the respondent authorities granted a scale of pay to fixed-pay work-charged employees. 

In this connection, in the present petition, the petitioner submitted that the rejection of their representation by the respondent authorities is discriminatory and violates Article 14 of the Constitution.

The State of Nagaland and the various functionaries of the Nagaland Public Works Department are the respondent authorities in the writ petition.
