The Nagaland Fire & Emergency Services Bill, 2021 was introduced today in the first session of 14th Nagaland Legislative Assembly (NLA) here.
The Bill was moved by Nagaland’s chief minister Neiphiu Rio on the floor of the House.
In statement of objects and reasons for the Bill, a copy which was made available on the floor of the House, Rio stated that the objective of the proposed the Nagaland Fire & Emergency Service Bills, 2021 is to regulate, control, operate, manage and activate the fire & life safety measures in the state.
“At present, with the growth of developmental activities and rapid urbanization, the state has seen a tremendous growth in infrastructural development in the urban areas. However, absence of regulations to monitor life savings and fire safety measures in high rise buildings and institutions both government and private, the state has, in recent years and lately, noticed major fire incidents and other hazards where cases of loss of human lives along with properties have been reported,” Rio stated.
In order to minimize these incidents and hazards and safeguard the common citizens of the state, it is felt expedient to introduce the Nagaland Fire & Emergency Services Bill, 2021 to reduce and augment the safety of all private as well as government, institutional buildings in order to mitigate the disasters in the state, it stated.
On memorandum of delegated legislation, Rio stated that the state government is delegated with the power to make rules under Section 61 of the Act to carry the purpose of this Act, adding that the delegated legislation is of normal character.
On memorandum of financial implication, Rio stated that the proposed introduction of the Nagaland Fire & Emergency Services Bill, 2021 shall be administered by the existing administrative set up of the home department and will not entail any financial implication for the implementation of the Bill.
Later, NLA speaker Sharingain Longkumer told the House that consideration and passing of the Bill shall be taken up on March 27.
Nagaland Goods and Services Tax (Sixth Amendment) Bill, 2022
The Nagaland Goods and Services Tax (Sixth Amendment) Bill, 2022, moved by Chief Minister, has also been introduced in the House today.
In statement of objects and reasons, Rio stated that the Goods and Services Tax (GST) has been implemented with effect from 1st July 2017.
The GST consists of the Central Goods and Services Tax and the State Goods and Services Tax. The Central Government has amended the Central Goods and Services Tax Act, 2017 through Finance Act No. 6 of 2022. The State Governments have to affect corresponding amendment in the respective State Goods and Services Tax Act.
“As the Legislative Assembly was not in session and the matter was urgent, the Governor of Nagaland, in exercise of powers conferred under clause (1) of Article 213 of the Constitution of India, promulgated the Nagaland Goods and Services Tax (Sixth Amendment) Ordinance, 2022 on 11th November 2022 which was notified in the Nagaland Gazette Extraordinary. The Nagaland Goods and Services Tax (Sixth Amendment) Bill, 2022 will make the Nagaland Goods and Services Tax Act, 2017 more comprehensive,” Rio stated.
The proposed Bill seeks to give effect to the above objects.
On Financial memorandum, Rio stated the introduction of the Nagaland Goods and Services Tax (Sixth Amendment) Bill, 2022 will not entail expenditure on the Consolidated Fund of the State as it can be implemented by the existing administrative set up.
NLA speaker informed that the consideration and passing of the bill shall be taken up on March 27.
CM lays Nagaland Information Commission Reports
Nagaland’s Chief Minister Neiphiu laid Nagaland Information Commission Annual Report 2020-2021 and 2021-2022 on the floor of the House today.
He also laid the Audit Report of Samagra Shiksha for the year 2021-2022 and Nagaland State Disaster Management Rules 2011.
Rio also laid the Annual Administrative Reports 2022-23 relating to the departments of Geology & Mining, Labour, Evaluation, Art & Culture, Science & Technology, Municipal Affairs, Water Resources, Animal Husbandry & Veterinary Services, Urban Development, Excise & Prohibition, State Council of Educational Research & Training (SCERT) and Department of Under Developed Areas (DUDA).
The Annual Administrative Reports 2022-23 of the departments of Planning & Co-ordination, Border Affairs, Public Health Engineering, Cooperation, Rural Development and State Institute of Rural Development have also been also laid in the House by the respective ministers.
Earlier, NLA secretary-in-charge Khruohituonuo Rio reported the assent of the Nagaland’s Governor on two bills;
The Nagaland Groundwater (Regulation and Control of Development and Management) Bill, 2020 and Nagaland Fiscal Responsibility and Budget Management (5th Amendment) Bill, 2022.
