Nagaland: Transport Dept sets 30-day deadline to renew 5+ year expired vehicle registrations

Kohima, December 3 (MExN): The Nagaland Transport Department has issued a 30-day deadline to vehicle owners who have not renewed their Certificate of Registration for five years or more, directing them to either renew their registration or apply for cancellation at their respective registering offices.

The department stated that failure to act within the stipulated period will compel the registering authorities to presume that such vehicles are incapable of being used, or that their use in public places would constitute a danger to the public and that they are beyond reasonable repair, and initiate cancellation under Section 55(3) of the Motor Vehicles Act, 1988.

Reminds on destroyed or unfit vehicles

Meanwhile, the Transport Department also reminded that under Sections 55(1) and 55(2) of the MV Act, owners of vehicles that have been destroyed or rendered permanently incapable of use must report the matter to the registering authority within 14 days to facilitate cancellation of the registration certificate.

It noted that many owners have failed to report such cases, as reflected in VAHAN data, leading to complications including inaccurate records, tax defaults, and the risk of unfit vehicles being used without valid fitness, pollution certificates, insurance, or HSRP.

Section 177A now a compoundable offence

As per the State DIPR, the department also notified that Section 177A of the Motor Vehicles Act—previously not compoundable—has now been made a compoundable offence following amendments under the Jan Vishwas (Amendment of Provisions) Act, 2023.

The Ministry of Road Transport & Highways brought the amendment into force through Notification S.O. 227(E) dated January 13, 2025. Consequently, officers empowered under State Government Notification No. TPT/MV/09/2019 dated November 12, 2020 may compound violations under Section 177A.
