Recommends bail or release of 18 Under Trial Prisoners for July- September quarter

Kohima, October 5 (MExN): The Nagaland State Legal Services Authority (NSLSA), under the aegis of the National Legal Services Authority (NALSA), conducted 11 meetings of the Under Trial Review Committee (UTRC) for the 3rd quarter (July- September).

The meetings were conducted through the respective District Legal Services Authorities (DLSAs) in September. 

According to an NSLSA release, in the 3rd quarter, 11 UTRC sittings were held across the State, during which 31 Under Trial Prisoners (UTPs) and convicts were considered for the review and 18 UTPs and convicts were recommended for bail or release.

Out of the recommendations made, 8 UTPs were released on bail by the court, but they could not furnish sureties, it said, while 2 persons were released.

Other recommendation for release was 7 UTPs detained under Chapter VIII of the CrPC under section 107,108,109 and 151 of CrPC and UTPs covered under Section 436 CrPC. 

The UTRC is headed by the DLSA Chairperson or Secretary who is a District & Sessions Judge or Magistrate and include heads of district administration, Police and Jail and panel lawyers. 

District-wise meetings 

Longleng DLSA: Two UTPs were released after its meeting held at Chief Judicial Magistrate Office. They were eligible to be released on bail under sections of the Narcotic Drugs and Psychotropic Substances Act, 1985 and 3 UTPs were given Legal Aid Counsel. 

Kohima DLSA:  UTRC reviewed the status of 54 UTPs and 9 convicts and recommendations were made regarding 2 UTPs to the concerned court to expedite their cases for early disposal as they have undergone half of the total imprisonment period.  Two UTPs were recommended for Legal Counsel. 

Phek DLSA: No UTPs were recommended for release while none were in requirement of medical intervention were observed at a UTRC setting held at at District Court Complex, Phek. There were 22 inmates, 19 UTPS and 3 convicts in Phek District Jail. 

Kiphire DLSA: The DLSA conducted the meeting on September 06 at District Jail, Kiphire but no recommendation was made. Presently,  there are 6 UTPs and 1 convict at the District Jail. 

Wokha DLSA: 1 UTP without legal representative was subsequently recommended for legal aid during its setting on on September 24. 19 UTPs and 2 convicts are currently lodged in the District Jail, Wokha. 

Zunheboto DLSA: Two UTPs were recommended for release at the UTRC meeting held at District Jail, Zunheboto. At present, there are 26 inmates, 24 UTPs and 2 convicts at the District Jail.

Tuensang DLSA: The committee recommended 11 for free legal aid during its meeting held at the office of the superintendent of District Jail Tuensang. As per jail authorities, there are 28 UTPs and 3 Convicts for simple imprisonment and 6 convicts for rigorous imprisonment. 

Peren and Mokokchung DLSA: The DLSAs conducted the sitting at respective District Courts. However, no recommendation for release or legal representation was made.  

Mon DLSA: UTRC Committee observed 4 UTPs to be eligible for bail by the court. However, no sureties were furnished.
