Disciplinary action: In regard to disciplinary action, it is pointed out here that I did not hold any assignment in the LOU, DHEP, for the fact that I have resigned as advisor before the disciplinary action initiated against me on 9/8/2011. Since I do not belong to LOU, DHEP official under any capacity, the question of my suspension and expulsion does not arise. Substantial reasons should be given on what ground the writers have the right to expel and suspend me from the membership of a bonafide land donor and take away my birthright. It is further clarified that LOU Membership and LOU, DHEP official and one being belonging to office bearer in completely different and no one can be removed from the membership of land owner for an individual who had given land to NEEPCO (Ltd).
It is clarified here again that I had not convened any meeting at my own will. It is a fact that a meeting was held at my residence as per the wishes of the majority executive members of the LOU. The majority members of the LOU endorsed to me in writing to convene a meeting for impeachment of Shri. Y. Odyuo, president, LOU, DHEP since members had lost confidence in him.
On 12/9/2011, DC, Wokha approved for impeachment of Shri. Y Odyuo, president, LOU, DHEP and Shri Y Odyuo was impeached in the conference Hall of DC, Wokha on the same day. Accordingly DC issued order directing the executive members to elect a new president within a period of 15 days vide order No. CON-54/2011_12 dated 12/9/201. As per this order, as convenor, I convened a meeting with the executive members in NRC Hall, Doyang for electing new president on 19/9/2011. While conducting for election of new president, Shri. M Daniel Lotha, secretary Ministry of Chaplee Affairs NSCN/GPRN (IM) called all of us to the DHEP guest house and obstructed the election under threat using abusive language against R Yanthan and Y Odyuo. He also issued order vide memo No. 19-18/MCA/2011 dated 22/9/2011 that R Yanthan and Y Odyuo were expeleed from the membership and barred to contest in the election and directed the LOU executive members to elect new members ignoring DC Wokha’s order no CON-54/2011-12 dated 12/9/2011. Thus M Daniel Lotha, secretary finance (IM) brought the problem in LOU, DHEP and the DHEP official functioning.
Since M Daniel Lotha obstructed the election process with high handed authority terrorizing the members present in the meeting, we closed together at NRC Hall on the same evening and decided that we would jointly go to the higher authority Hebron to present our case for redressal of justice on 23/9/2011, we went to Hebron and called on the Kilo kilonser and all other Kilonsers at Hebron, Nagalim. While we were actively engaged in seeking our grievances for justice at Hebron, Shri. P Roland Ezung who became self styled sessional secretary conducted election basing on M Daniel Lotha’s order (relevant documents already submitted to you for your ready references) and made Wopan Lotha, the president, LOU DHEP without observing democratic norms. This has created more problems and confusion within the LOU set up and DHEP official functioning.
About the mandate and legitimate LOU, DHEP (NGO), it is clarified for information to all concerned that without the approval of the general body in the general meeting, it cannot be recognized as mandated and legitimate officials. Has the present set up of LOU, DHEP done so? Let the people say as the people are the best judge. Therefore they have no authority to talk about condemnation. It is further clarified that there are about 21 land affected villages under Doyang project which they are not at all happy for the fact that they are functioning the office without people’s mandate.
Referring to 2006 LOU, DHEP constitution, it is clarified that the framers of this constitution have done without inviting the Sema land affected villagers. In this regard we have jointly placed our complaint to the authorities concerned for its rejection. It is further clarified that if any decision is made based on 2006, LOU, DHEP constitution, we will desist from the union and form separate LOU, DHEP under Zunheboto district.
If at any time problems involving law and order develops, Shri. A Peter Jami and Shri. P Roland Ezung, self styled working president and general secretary shall be held responsible.
