The Wokha District Bar Association convened a sensitisation programme on the newly enacted criminal laws at the Hammock Resort, Wokha on August 3 with Chairman of the District Legal Services Authority, Longshithung Ezung, and Advocate Limhathung Ezung as the resource persons of the event.
The objective of the programme was to impart knowledge on the recent criminal laws, the Bharatiya Nyaya Sanhita (BNS), 2023, and the Bharatiya Sakhsya Adhiniyam (BSA), 2023. The resource persons elaborated on the Defence counsel approach to procedural laws and rights of the accused persons and art of trial.
In his address, District Legal Services Authority Chairman, Longshithung Ezung lauded the initiative, remarking that such sensitisation programmes for solicitors are a rarity. He encouraged the attendees to practice law not solely for pecuniary benefit but to sincerely assist the judiciary in the fair dispensation of justice.
Discussing the new laws, he noted that while the changes are not sweeping, there are significant revisions and additions in various sections. He acknowledged the possible challenges, especially during the transitional phase where cases registered prior to July 1 will adhere to the old laws, whereas those filed thereafter will be governed by the new laws. He provided a comprehensive elucidation of the new bills and urged the lawyers to acquaint themselves thoroughly with the updated laws.
Advocate Limhathung Ezung emphasised on the newly introduced definitions and amendments in the legislation. He emphasised the introduction of community service as a rehabilitative measure and a punitive option for first-time offenders. He explained that offences such as public servants unlawfully engaging in trade, attempted suicide, and theft under five thousand rupees with recovery, public misconduct by an inebriated individual, and defamation could result in community service penalties. He also discussed the concept of abetment of offences under the new legal provisions.
It was also mentioned during the programme that there are currently 53 registered lawyers under the Wokha District Bar Association. The event was chaired by Advocate Orenvungo Humtsoe, with a melodious rendition by Advocate Zujanbeni Tsanglao, and Advocate Zuchumpeni Ngullie delivering the vote of thanks.
