DIMAPUR, DECEMBER 1 (MExN): ACAUT Nagaland today demanded that the Department of Higher and Technical Education (DHTE) advertise all 207 posts of Assistant Professors, with regard to which two petitions have been filed by the Nagaland Net Qualified Forum (NNETQF).
The demand came, as ACAUT cited a notification from the Nagaland Government dated November 28, 2019, informing heads of departments that the Guwahati High Court has upheld a Supreme Court judgement outlawing the State Government’s Office Memorandums (OMs) on regularization of contract/ad-hoc employees.
In a judgment dated February 7, 2019, the Gauhati High Court upheld that the judgement passed by Supreme Court in the case of Umadevi (3) (supra) is above the OMs of the state. This was with regard to a writ appeal involving the State of Nagaland-ACAUT and others. Following the HC’s order, the government directed departments to compile list of contractual employees.
A press release from the ACAUT media cell pointed out that the NNETQF had also filed two writ petitions challenging the appointment of 207 Assistant Professors allegedly “through backdoor” and also for non advertisement of 110 post creations.
The ACAUT informed that out of the 68 post created for the year 2018-19 only 63 were advertised and 5 posts are withheld by the Department of Higher Technical. Meanwhile, the 42 posts created for the year 2019-20 have not yet been advertised.
The ACAUT demanded that the remaining 47 post must be advertised along with about 50 sanctioned posts being occupied by the contract appointees and a total of about 97 post must be advertised before the start of the next academic session.
“Any stop- gap arrangement without public advertisement is illegal as per the law,” the ACAUT said.
It meanwhile said that the NPSC should go ahead with the Common Educational Services Examination, 2019 without any other changes as per the original advertisement, after it has fulfilled the compliance of disability reservation.
The ACAUT further expressed support to the Civil Engineer Association Nagaland (CEAN) ultimatum backed by Combined Technical Association of Nagaland (CTAN) demanding the termination of 30 SOs grade II, 7 draftsmen and 7 surveyors.
The ACAUT stated that the notification dated November 23, 2019 for 9 SOs Grade II are only for the existing vacancies, and does not include the 30 such posts allegedly filled via backdoor. It said that all the posts should be re-advertised immediately “otherwise the department is liable for lawsuit.”
