Clarification on land encroachment

I would like to bring forth the truth based on factual and documental evidence with notification and High Court order, as an eye opener to the Chairman of Seluophe Village since he was ignorant about the legal facts on official records.

1. That, Tsithrongse Village was recognized by the State Government vide order No: GAB- 9/5/91 dt. 03.02.92 with the boundaries as:

North: Dhansiri River.

East: Singrijan by foot path.

South: PWD Road.

West: Murise.

2. That, the above notification was modified by the State Government by notification No. GAB- 9/5/91 dt. 13.04.94 about its boundaries citing

North: Dhansiri River.

South: Khopanala River.

East: Khopanala River.

West: Murise Village.

3. That, aggrieved by the latter notification, Tsitrhrongse Village went to HC for redressal in civil rule No.1513 of 1994 and civil rule 3201 of 1998.

4. That, in both the cases the HC had ruled that the earlier Govt. notification dt. 03/02/92 shall prevail.

5. That, the Chairman of Seluophe Village may be ignorant about the HC order dt. 30.05.96 and 26.06.98 “In the meantime the operation of order at annexure- L (i.e. notification dt.13.04.94) shall remain suspended and the order dt. 03.02.92 passed in respect of the boundary of Tsithrongse Village shall prevail”.

6. That, basing on the said HC order the then ADC Dimapur Khalo Kapfo has given clear administrative order vide order No.VLS-1/92-D/1564-7 dt. 25.04.97 “In view of the aforesaid court standing order the people of Seluophe Village (unrecognized) are hereby restrained to enter and disturb Tsithrongse villagers within its boundary given in the Govt. notification issued on 03.02.92”.

7. That, in addition to that then DC Dimapur Imkongtemsu has given an order vide No. VLS-1/90-D/7448-51 dt. 16.10.02  “Whereas it has come to the notice of the undersigned that Seluophe Villagers are carrying out construction of houses within Tsithrongse Village area, the Seluophe villagers are ordered to stop all construction immediately. They are also ordered to dismantle all the houses constructed within Tsithrongse village”.

8. That the Chairman of Seluophe had said that peaceful living is effected by land encroachment and that it should be stopped. Hence, it is pertinent to mention that we are binded by the Govt. notification not by the encroachment principle.

In spite of the above referred orders they had encroached the land for which they themselves admitted.

Therefore, the above are our clarification to your article and would like to suggest that before you go to the press you should aquaint with the facts.

We would also like to bring to the notice of the state government that in spite of all our rights it refuses to recognize our apathy.
Thus we are humbly looking forward that, the state Govt. will intervene and take appropriate and immediate action to maintain peaceful co-existence.
