Cyber crime accused released on bail

Cyber crime accused Pankaj Gupta has been released on bail on August 5 after furnishing PR bonds and surety as directed by the court. 

Confirming the news, Advocate of the accused, Joshua Sheqi told The Morung Express that Pankaj Gupta has been released after furnishing Personal Recognizance bond of Rs 1 lakh along with two surety bonds of the like amount furnished by residents of Nagaland.

The accused was granted bail on July 27, however was not released until August 5. It may have been delayed due to lockdown but also because of apprehension of our people to stand as local sureties, the advocate also mentioned.

The court during the grant for release stated that the accused shall be released on furnishing of PR bond of one lakh rupee with two surety bonds of the like amount which should be furnished by residents of Nagaland.

Meanwhile, the advocate also informed that a petition has also been filed “for quashing the proceedings against him under Sec 482 CrPC.”

Earlier, a bail petition under section 439 of CrPC was filed in the court for Pankaj Gupta who was arrested on June 9, 2020. 

Recalling the sequence of events, Gupta had earlier released a video through You Tube alleging that the Chief Minister of Nagaland and his Government were preparing to carry out a conspiracy to spread COVID-19 virus among the people of Nagaland in order to get more fund from the Central Government. He also challenged the Chief Minister for a debate on any electronic media, on the actions that has been taken so far by the Government in dealing with the spread of COVID-19 and regarding the short comings thereof.

Counting from the date of arrest, the accused was in judicial custody for almost two months.
