Doyang LOU controversy flows on

Dimapur, Oct 10 (MExN): The standoff between the two sets of DHEP Land Owners Union executives each claiming to be the legitimate body, continues. In a latest missive, the executives under O Mozamo Ngullie have issued a reaction to the executives led by Wochamo Ngullie refuting claims of a court order declaring the former as legitimate. Mozamo’s camp has issued a note of events asserting the legitimacy.

According to the 11 executives under Mozamo, an executive meeting of the union was held on May 10 2006 at Colony-1 of DHEP where 36 executives attended out of 48. The meeting thoroughly discussed the functioning of LOU president Wochamo Ngullie and some of his office bearers where it was highlighted that “office status” was being misused “taking only his own pocket decision” without consulting the house. Taking this into account the House unanimously resolved to withdraw support to the then team led by Wochamo Ngullie and was declared as derecognized. The grounds for the de-recognition, according to the rejoinder, were ‘total failure to take the house or affected villages into confidence, failure to seek approval for his (Wochamo’s) leadership and formation of the team even after a lapse of 10 months, undertaking “agitational” programmes without proper and prior consultations or approval of the House and affected villages, “all round inability and failure to lead the union” and that the House and affected villages had lost confidence in his (Wochamo’s) leadership.’

On May 10, 2006 the House unanimously resolved to constitute the union and draft its constitution with immediate effect and basing on which another executive meeting held on June 28 at Colony-1 elected unopposed O Mozamo Ngullie as president of the union. All executive members attended the meeting, it stated. The election was followed by induction of other office bearers for 5-year tenure as per its constitution. Hence, since June 28 there is no dispute in the matter of LOU, the clarification stated.

The release then expressed surprise that Wochamo had filed a civil contempt petition in the court of the ADC (J) Wokha against Mozamo and seven others alleging violation of a court order for which the ADC (J) passed an order September 5, 2006 contempt file restraining Mozamo and his team for  interfering and disturbing the functioning of LOU “which is unknown to law”. There, taking strong exception of the said order O Mozamo Ngullie and his team filed a petition in the Guwahati High Court, Kohima Bench on September 21 challenging the impugn. After thorough perusal of the petition, the court found that “the petitioners have not committed any offence against the law; hence the petitioners have a prima facie case for interfering and function of the union”. Thereby, it set aside and stayed the earlier order of the Wokha ADC (J) September 5. The release questioned why and on what ground Wochamo and Bijamo claimed that the HC had not passed any stay order in this connection.

The release also questioned allegations that Mozamo did not donate any land to DHEP. It stated that Mozamo has a land owner certificate bearing Sl.No.168 dated February 12 1999 issued by former union President YP Jami when Bijamo Yanthan was General Secretary. Wochamo Ngullie also did not object to nomination of Mozamo as president when elections were held at Doyang public ground.
