Dimapur, February 15 (MExN): Three contentious election-related resolutions adopted by the Longkhum Chungli Mongsen Youth, Alichen Youth and the Alichen Council which fall under the Koridang Assembly Constituency (AC) in support of a particular candidate, has been declared ‘null and void,’ as per an order issued by the Mokokchung District Magistrate in February 15.
The order follows the Kohima Bench of Gauhati High Court’s interim stay order on the resolutions on February 14 and direction to the Deputy Commissioner of Mokokchung to make an enquiry and direct the three organisations to withdraw the resolutions.
If the resolutions are still in operation, the Court tasked the DC to take necessary actions against the three organisations as per the law.
Accordingly, District Magistrate Shashank Pratap Singh stated that the resolutions dated June 28, 2022, September 17, 2022, and October 22, 2022, issued by the three organisations respectively, “have not only been found against the spirit of the free and fair election but also violates the statutory rights of the individuals/electors of the Longkhum village and Alichen ad-hoc town to participate/contest in the election on the basis of free will.”
The chairman of Longkhum Village Council and Chairman/Vice-Chairman of Alichen Town Councill/Alichen Urban Station Committee have also been directed to appear before the court of the Mokokchung District Magistrate on or before February 17 with “written submission as to why action shall not be taken against them as per the relevant sections of CrPC and other election-related laws for willful disobedience.”
Non compliance may invite penal and other legal actions as per the relevant section of law, the order stated.
