Nagaland UTRC recommends release, bail for 14 under trials

Dimapur, April 18 (MExN): The Under Trial Review Committee (UTRC) has recommended discharge or bail for 14 under trial prisoners (UTP) from jails across Nagaland, out of which five applications were moved post-recommendation and two were released.

According to a press release on Monday, the UTRC held its first quarter meetings throughout the month of March across the districts and considered the case of 49 UTPs. 

The release stated that in Mokokchung, the meeting was held at the District Court and was chaired by WV Patton, secretary, MDLSA. Somet Chang, chairperson, MDLSA, Aotula SP, Mokokchung, EAC Vitulo from District Administration, Jessica, jailer from SP jail, APP attended the meeting.

Mon DLSA conducted the meeting through video conference and upon perusal of the meeting, eight UTPs were recommended for release on bail. The UTRC also reminded that the families of two UTPs who were recommended during the last UTRC meeting should be informed as their bail orders have been passed by the Court and the sureties are to be executed. All 57 UTPs and 15 convicts were reported from the jail authority, the release stated, adding that WV Patton (NJS) Chief Judicial Magistrate-cum-Secretary DLSA Mon, Chingak Konyak (NCS) ADC Mon, Imtiakum SDPO, Thungdemo Lotha, Asst Jailor and M Moba, Retainer Lawyer attended the meeting.

In Longleng, the meeting was conducted on March 30 with CJM Longleng, Superintendent of Police, EAC, Public Prosecutor-cum-Government Pleader, Panel Lawyer, LDLSA in attendance. Presently, there are 16 UTPs lodged in Mokokchung District Jail and all UTPs have been legally represented. A total of three UTPs were identified for default bail and informed of their rights under Section 167(2) CrPC, the release stated.

On the same day, the Tuensang DLSA conducted the UTRC meeting at the office of Superintendent of Jail, Tuensang with SP Jail Solezhol Neikha, project assistant Soteth Anar, retainer lawyer Antimangyang Chang, jailor T Sangle, assistant jailor Chubasangle Chang and Front office Assistant TDLSA Muthiam. During the meeting the members decided to start having physical production in the court and three UTPs were recommended for legal aid. Presently, one female and 28 male UTPs, four male convicts (SI), and five male convicts (RI) are in the district Jail Tuensang.

The UTRC meeting for Peren district jail was conducted on March 29 and was presided by Peter Resu, CJM Peren. It was attended by James Jami, SDPO Peren, Ihoilung EAC Peren, Asungbe N Hau (Retainer Lawyer PDLSA), Italang Ramlia (Project Assistant PDLSA) along with Bankathung Patton (Asst. Jailor). According to the release, the committee discussed about the medical facilities to be accorded to the inmates of Peren District Jail and urged the Jail Authorities to provide the necessary medical aid and facilities as and when required at the earliest. The SDPO, Peren James Jami also reassured that proper security details have been put in place for transportation of inmates for medical or any other purpose. The budget allocation for medical expenses for inmates was also discussed in the meeting wherein the Jail Authorities highlighted that the sanctioned budget for medical expenses for Peren District Jail was inadequate to meet the required expenses. They said that ‘charitable contribution’ from Jail Officers and staff are being done to meet any urgent and immediate medical expenses, according to the release.

At the chamber of the PD&SJ Dimapur on March 24, the meeting was attended by Inalo Zhimomi, PD&SJ; Seyielenuo Mezhü, CJM; C Motsunthung Yanthan, Supt of Jail, District jail; Yanshumthung Jungio, Asst. Jailor, Central jail; Tiamenla ADCP; Sonile Seb, Retainer lawyer and Nukshimatong, EAC. In the meeting, 10 UTPs were identified and recommended for release while two UTPs from central jail were found to be mentally unsound. In this connection, the jail authority was directed to take them to a psychiatrist for evaluation of their mental condition and place the report before the DDLSA chairperson.

Kohima DLSA held the UTRC meeting on March 23 with the attendance of UTRC chairperson & Principal District and Sessions Judge Kohima Y Longkumer, Nokshei Kano (CJM and Secretary KDLSA member), Teisi Thou (Jailor, District Jail Kohima) and Imsentila Pongen (PL in-charge legal aid clinic).

The release stated that the UTRC meeting at Zunheboto on March 22 was held at the District Court Complex and chaired by Wokono Yhoshü, Secretary, ZDLSA. At present there are 16 UTPs and six convicts in the District Jail and one recommendation was made by the committee. Shikato Swu (SDPO), Mopling Phom (EAC), Jenithung, (Asst. Jailor), Katoli T Chishi (APP), Tovi Yeptho (DPA), Easter Yepthomi (RL) and Inolito Swu (PL) attended the meeting, it said.

Meanwhile, Wokha DLSA held the meeting on March 15 with the following members: Duvelu Vero, Chairperson/ District & Sessions Judge Wokha; Khrievono  Seletsu  Secretary/JMFC; Imkongsangba Jamir SDPO; Yanrenthung Kikon, Superintendent of Jail; Akatoli Achumi, APP Wokha; Shanchobeni P Lotha, DPA; Meribemo A Lotha Retainer Lawyer, and Renbonthung Tsanglao, Panel Lawyer District Jail Wokha .

The Kiphire DLSA also held the UTRC meeting on March 9 at District Court Complex, Kiphire, the release stated.
