NCD tussle: Court rejects new execs’ stay appeal

The Naga Council Dimapur (NCD) continues to exist in a state of limbo as the tussle over office occupancy among members has transformed into what appears to be a bitter court battle. 

Giving its ruling in an Interlocutory Appeal (IA 93/2020) filed by members challenging the legitimacy of the newly inducted executives, Civil Judge (Senior Division), Dimapur, on October 19, had restrained the new team from functioning as office bearers of the NCD. The court also directed the contending parties to approach the court “for further orders as deemed fit for appointing a caretaker.”

In response, the new team filed an Interlocutory Appeal at the Principal District & Sessions Court calling for staying the October 19 directive “pending disposal of the main Civil Appeal 3 of 2020” on grounds of legal technicality. 

The Principal District court passed the ruling to this appeal on November 19 rejecting the appeal for stay. 

In the ruling, the court stated that staying the October 19 directive “at this stage would lead to multiplicity of litigation,” adding, “This court would not like to comment on the admissibility or legality of IA 93/2020 also as that would mean going into the merit of the main appeal.”
