The current political crisis entered into new terrain today with the Nagaland Chief Minister Dr. Shürhozelie Liezietsu rejecting the Governor’s directive to obtain “Vote of Confidence” on the floor of the Nagaland Legislative Assembly on or before July 15.
Earlier during the day, Nagaland Governor PB Acharya issued the directive following the claim submitted by former Chief Minister, TR Zeliang to form the new government stating that he commands support of 34 MLAs and seven Independent MLAs of the NLA.
However, the Chief Minister in a letter addressed to the Speaker, citied previous legal precedence, and said that “The Supreme Court has clearly laid down that the Governor has no authority on his own to summon, prorogue or dissolve the Legislative Assembly.”
“He can only do so on the aid and advice of the Council of Ministers headed by the Chief Minister,” stated the response released by the CMO. While acknowledging the Governor’s directive, it said, “The Council of Ministers headed by me as Chief Minister has not advised the Governor to summon the State Legislative Assembly.”
It cited the recent ruling of Supreme Court on “Nabam Rebia and Damang Felix vs. Deputy Speaker, Arunachal Pradesh Legislative Assembly and Ors.”
“This being the inescapable position of law, since the Council of Ministers has not advised the Governor to summon the State Legislative Assembly, the question of summoning the State Legislative Assembly on or before 15/07/2017 does not arise.”
The Chief Minister’s response was routed through NLA Speaker Dr. Imtiwapang.
Meanwhile, according to an IANS report, the Nagaland Governor, late on Tuesday evening postponed the floor test in view of the presidential elections on July 17. The floor test is postponed till further notice, IANS reported.
