Two government resolutions were adopted today in the 2nd session of the 14th Nagaland Legislative Assembly (NLA).
Chief Minister Neiphiu Rio moved the government resolution on adoption of the Protection of Children from Sexual Offences (POCSO), Amendment Act 2019, and the POCSO, Rules, 2020; and it was adopted by the House in unison.
The state government had adopted the POCSO Act 2012 on September 26, 2016.
The Ministry of Law & Justice notified POCSO (Amendment) Act 2019, amending the POCSO Act of 2012 on August 5, 2019 under Article 252 of the constitution and subsequently adopted by various states.
In exercise of the powers conferred by Section 45 of POCSO Act, 2013 (32 of 2012) - powers to make rules, Ministry of Women and Child Development developed and notified POCSO Rules 2020 on March 9, 2020.
The CM said that the cabinet has approved for adoption of POCSO Amendment Act 2019 and POCSO Rules 2020.
The House also adopted in unison to repeal the employment of Manual Scavengers & Construction of Dry Latrines (Prohibition), Act , 1993 to enable the state government to take further action for the adoption of the new Act i.e. the Protection of Employment as Manual Scavengers and their Rehabilitation Act 2013.
Earlier, Rio, while moving the resolution, said that stated that the state government had adopted the Employment of Manual Scavengers & Construction of Dry Latrines (Prohibition), Act, 1993' in 2008.
The Act has become redundant with the enactment of the new Act i.e the Prohibition of Employment as Manual Scavengers and their Rehabilitation Act 2013.
The Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition), Act, 1993 was enacted by the Parliament under Article 252 of the Constitution and subsequently adopted by various states. Its repeal can be done away only as per the procedure prescribed under Article 252 which requires passing of resolution for the repeal of the 1993 Act by the State Legislature.
In this, the cabinet has approved for repeal of the Act of 1993.
