Nature of our appointments different from others, say NRMSATA 2013, NSSATA 2010 & 2013 Batch
Dimapur, September 3 (MExN): The government of Nagaland and teachers appointed under two batches of Nagaland SSA Teachers' Association, NSSATA (2010 & 2013) and one batch of the Nagaland RMSA Teachers' Association (NRMSATA) 2013 may be heading for a collision over the ‘nature of appointment.’
Both sides, in separates press releases, made contradictory claims about the nature of the teachers’ appointment to their present job.
The Nagaland SSA Teachers' Association, NSSATA (2010 & 2013) and the Nagaland RMSA Teachers' Association (NRMSATA) 2013, today stated that the teachers under the batches were “appointed as regular employees as per the nature of our appointment.”
In separate press statements, the two associations stated that they are entitled to enjoy the benefits as a regular state’s government employees.
Accordingly, the teachers are endowed with a pay scale, with all other allowances/rates prescribed by the Government of Nagaland from time to time with effect from the date of joining and deduction towards NPS and GIS, stated NSSATA (2010 & 2013) in press release issued by its president Penthungo Y Yanthan and general secretary Vinoka Sohe.
It further informed that a RTI reply from the concerned department had also clearly stated that, “Post creation is not done by the SSA, it is a Government of Nagaland undertaking. Hence teachers are appointed on a regular basis and their service is not co – terminus with SSA project.”
In this connection, the NSSATA (2010 & 2013 Batch) pointed out that unlike other contractual and adhoc-fixed teachers, “the SSA teachers of 2010 & 2013 batch along with the RMSA 2013 batch are regular employees as per the advertisement and the nature of appointment.”
Meanwhile, the RMSA 2013 batch also clarified that as per the nature of their appointment the batch along with SSA 2010 & 2013 batch “were not brought under the purview of the OM which was served to the contractual subject teachers under RMSA regarding the new fixed pay.”
Stating that they were appointed as regular employees by the State Government as “clearly written” in the appointment order issued by the Directorate of School Education, a press release from NRMSATA 2013 President Mhasikholie Paul Belho and General Secretary Vika S Sumi further stated that the OM (new fixed pay) is not “applicable to RMSA 2013 and SSA 2010 & 2013 batch.”
Co-terminus and contractual
Meanwhile, in a press release against the backdrop of ongoing Nagaland RMSA Teachers Association-2016 agitation, the Government said that their appointment was done directly by RMSA mission authority, not by the state government with many binding clauses. Among others, the release said, the clauses stated that the “service is purely on contractual basis and is liable to be terminated with one month notice as and when deemed fit by the appointing authority.”
The tenure of engagement was co-terminus with RMSA scheme. It was not clear whether the said clauses were applicable to NRMSATA 2013 and NSSATA (2010 & 2013) batches. However, the clarifications came from both the associations were in response to an ‘Office Memorandum’ regarding the nature of their appointment .
