State Assembly resolution cannot repeal constitutional provisions: NPCC

Dimapur, July 16 (MExN): The Nagaland Pradesh Congress Committee (NPCC) on Thursday said that Resolution by the State Assembly cannot repeal the provisions made in the Constitution.


Reacting to the NDPP’s statement that “Nagaland State Assembly has in a resolution done away with Art. 371A (1) (b)”, NPCC President K Therie said that NDPP should not make a mockery of itself.


He said that “Dr SC Jamir, former CM and Governor, the lone living signatory of the 16 Point Agreement from where Art.371 (A) is derived has also made it clear that, as long as the Article is not amended by Parliament, the provisions are alive.”


The Congress has clarified the actual position as “others will assume Nagaland State people are ignorant of constitutional procedures,” Therie said.


Further, stating that the current ‘mess’ is the NDPP’s own creation, Therie said they should not blame others for it.


The Governor should have dismissed the Government for abdicating its Constitutional responsibilities and for unabated extortion and corruptions instead of assuming special responsibility with respect to law and order, he added. “They decided to merely facilitate the ongoing peace process shifting from the commitment to play an effective role in securing a negotiated settlement,” the NPCC President said.
