CPO questions Nagaland Govt over compensation delay

Kohima, AUGUST 10 (MExN): The Chakhesang Public Organisation (CPO) Committee and PIL petitioner with regard to Phek-Pfutsero 2 lane road compensation case has written to the Chief Secretary on non compliance of the High Court’s order on this matter. 

The CPO Committee said that the Government has not complied with the Court Judgment and Order dated January 30, 2023, that the exercise should be completed within 6 months.

The Court had ordered that the State Government shall make the first move by submitting a proposal with the assessment made to the Central Government Ministry concerned. It had also directed that on receipt of the same, the Ministry shall initiate the process of allocation of fund release of the same to the State Government. 

Thereafter, the State Government was ordered to disburse the same through the Deputy Commissioner of the district concerned, to the genuine land owners whose lands, properties, standing crops and trees etc, have been damaged or destroyed during construction of the road. 

This entire exercise was to be completed within a reasonable time but not beyond six months from the date of the Judgment and Order. The CPO Committee said that this is has not be done. 

It asked the Chief Secretary as to why the government has not complied with the Court Judgment and Order, and asked for immediate intercession. 

The committee also made available a letter from the Chief Secretary, dated May 12, 2023, regarding the proposal for claim of compensation for properties damaged during the execution for 2-Lane Pfutsero-Phek road and Chakabarna-Zunheboto road under SARDP-NE amounting to Rs 60,94,36,685. 

It stated that “as per the direction of the court a copy of the assessment which was conducted by a joint survey comprising of officers of the State Government, aggrieved persons and members of local administrative bodies on February 27, 2017 is also enclosed.”

The Chief Secretary asked those concerned to “look into the proposal for further allocation of fund and release of the same to the State Government so that the proposed 2-laning work will be carried out unhindered.”
