Naga Club members get anticipatory bails

Moves petition to quash FIR

New developments are taking place in connection to the demolition of the building occupied by the Naga Students' Federation (NSF) office, among others and shops on May 27 morning.

In a latest development, 6 persons, all members of the present Naga Club (NC) filed interim anticipatory bail application in the Gauhati High Court, Kohima Bench today in the morning apprehending arrest in connection to the First Information Report (FIR) complaint filed by the Naga Students' Federation (NSF) under various sections for demolition of office by unknown persons. 

The members, namely—Kuolachalie Seyie, Gwanilo Himb, Nezonyu Robert Solo, Khriedi Theunuo, Viketuolie Pienyu and Prasielie Pienyu had filed the bail applications separately in the court on May 29 morning. 

Hearing identical matters of the aforesaid persons in the unlisted motion today, Justice Mridul Kumar Kalitam, after hearing submission of the petitioners and the government advocate, directed the petitioners to appear before the investigating officer within 3 days from the date of the order and co-operate with the investigating officer. 

“If he does so within stipulated time, in the event of his arrest in connection with the said case, the arresting authority shall allow him to go on bail of Rs 20,000 with one surety of like amount to the satisfaction of the arresting authority, till next date of this case,” the order read. 

Identical orders were separately issued for all the six applicants and the anticipatory bails were granted to them along with a bail bond of Rs 20,000.

Anticipatory or pre-arrest bail is a legal provision that allows an accused person to apply for bail before being arrested.

The respondents or Government advocate was also granted 7 days to seek necessary instructions from the government for filing any objection as well, after which the next date of hearing was fixed for June 5.

Plea to quash FIR
Meanwhile, in a separate filing, the Naga Club, represented by its President Kuolachalie Seyie, moved the HC Kohima Bench for quashing of the FIR filed by the Naga Students’ Federation with regard to the demolition of their office on May 27. Accordingly, a case was registered in Kohima North Police Station. 

The petitioners prayed for quashing of the said criminal proceeding. The Government of Nagaland and NSF are listed as the respondents of the petition and accordingly notices were issued to them returnable in two weeks.  

Let this case be listed accordingly after 2 weeks, stated the order issued by Justice Kalita, without issuing any direction on the plea for the quashing of the FIR.

It may be noted here that in a representation to the Officer-In-Charge, North Police Station, Kohima on May 28, the Naga Club maintained that the FIR was “malicious, baseless, misconceived and misleading.”

Accordingly, it denied ‘vandalisation of any public properties’ or ‘public trespass’ but maintained it “entrusted” some youth on May 27 to “demolish” some structure as “bonafide owner of the land and building.”

Police make 3 arrests through CCTV footage identification
Meanwhile, 3 more persons have been arrested by the Police in connection with the investigation over the incident.

Informing this to The Morung Express, Additional SP & PRO, Relo T Aye, said the latest arrests made were identified through the CCTV footage. He said more are on the lookout. 

The PRO said till now the authority has received no direction from the High Court regarding the grant of anticipatory bail.

Considering the facts and circumstances of this case, the petitioner is directed to appear before the Investigating Officer of this case within three days from the date of this order and cooperate with the Investigating Officer.
